MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection AN ACT to amend the general business law, in relation to requiring lodg- ing facilities to set air conditioner default settings to certain temperatures The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The general business law is amended by adding a new section 2 206-g to read as follows: 3 § 206-g. Air conditioner default settings. 1. For purposes of this 4 section, "lodging facility" shall mean any inn, hotel, motel, motor 5 court or other establishment that provides lodging to transient guests. 6 Such term shall not include an establishment treated as a dwelling unit 7 for the purposes of any state or local law or regulation or an estab- 8 lishment located within a building that has five or less rooms for rent 9 or hire and that is actually occupied as a residence by the proprietor 10 of such establishment. 11 2. A keeper of a lodging facility shall not set the default temper- 12 ature setting on any air conditioner located in any room or common area 13 (a) lower than seventy-five degrees Fahrenheit between the months of May 14 through October and (b) higher than sixty-four degrees Fahrenheit 15 between the months of November through April. 16 § 2.
