        Introduced  by  Sen.  KAPLAN -- read twice and ordered printed, and when
          printed to be committed to the Committee on Transportation --  commit-
          tee  discharged, bill amended, ordered reprinted as amended and recom-
          mitted to said committee

        AN ACT to amend the public authorities law, in relation to  establishing
          a moratorium on the increase in rates of railroad fares established by
          the  metropolitan  transportation  authority;  and  providing  for the
          repeal of such provisions upon expiration thereof

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  The  public  authorities  law  is amended by adding a new
     2  section 1279-i to read as follows:
     3    § 1279-i. Moratorium on railroad fare increase; positive rail  control
     4  implementation. Notwithstanding any other provision of law, on and after
     5  January first, two thousand twenty, a moratorium shall be established on
     6  the increase in the rates of fare established by the metropolitan trans-
     7  portation authority for any railroad operated by the metropolitan trans-
     8  portation  authority  or  any  of its subsidiaries for passengers riding
     9  such railroads and such rates of fare shall be fixed  at  the  rates  of
    10  fare  in existence on December thirty-first, two thousand nineteen. Such
    11  moratorium shall continue in effect until all railroads operated by  the
    12  metropolitan  transportation  authority  or any of its subsidiaries have
    13  fully implemented the  positive train control requirements of the feder-
    14  al rail safety improvement act of 2008. Upon such compliance such  mora-
    15  torium shall be lifted.
    16    §  2.  This  act shall take effect immediately and shall expire and be
    17  deemed repealed when all railroads operated by the  metropolitan  trans-
    18  portation  authority  or  any of its subsidiaries have fully implemented
    19  the positive train control  requirements  of  the  federal  rail  safety
    20  improvement act of 2008; provided that

     1    1. the provisions of this act shall apply to rates of fare established
     2  by the metropolitan transportation authority on or after January 1, 2020
     3  for  any  railroad operated by the metropolitan transportation authority
     4  or any of its subsidiaries for passengers riding such railroads; and
     5    2. the metropolitan transportation authority shall notify the legisla-
     6  tive  bill  drafting commission upon the occurrence of the compliance by
     7  the  metropolitan  transportation  authority  with  the  positive  train
     8  control  requirements of the federal rail safety improvement act of 2008
     9  as provided for in this act in order that the commission may maintain an
    10  accurate and timely effective data base of the official text of the laws
    11  of the state of New York in furtherance of effectuating  the  provisions
    12  of  section  44  of  the  legislative law and section 70-b of the public
    13  officers law.
