AN ACT allowing nonresident full-time students to purchase resident licenses for hunting and fishing.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT allowing nonresident full-time students to purchase resident licenses for hunting and fishing.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Fish and Game; Definitions; Resident. Amend RSA 207:1, XXIII to read as follows:

XXIII. Resident. A resident of the state as defined in RSA 21:6, except that no person shall be deemed to be a resident who claims residence in any other state for any purpose, provided however that residency requirements prescribed in RSA 214:7-b shall apply.

2 Fish and Game Licenses; Residency; Nonresident Full-time Students. Amend RSA 214:7-b to read as follows:

214:7-b [Minimum] Residency [Required] Requirements.

I. Any person who is otherwise qualified for a resident hunting or fishing license or both, issued without charge pursuant to the provisions of title XVIII, shall furnish proof that he or she has resided within the state for at least 2 years immediately preceding his or her application for said license and has not during that time claimed a residence in any other state.

II. A nonresident full-time student may purchase a resident license for hunting or fishing issued under the provisions of title XVIII. For purposes of this paragraph, “full-time student” means a student who is registered for at least 12 credit hours per semester at any public or private postsecondary educational institution in this state.

III. Any person who willfully makes a false statement relative to [his] residency in applying for said license shall be guilty of a misdemeanor.

3 Effective Date. This act shall take effect 60 days after its passage.

HB 1290-FN - FISCAL NOTE

AN ACT allowing nonresident full-time students to purchase resident licenses for hunting and fishing.

FISCAL IMPACT:

The Fish and Game Department states this bill, as introduced, will have an indeterminable impact on state restricted revenues and expenditures in FY 2014 and each year thereafter. There will be no impact on county and local revenues or expenditures.

METHODOLOGY:

The Fish and Game Department states this bill would allow a nonresident full-time student to purchase a resident license for hunting or fishing. The Department states it cannot estimate this bill’s potential impact on fish and game fund revenues or expenditures as it cannot predict how many nonresident licensees would purchase a license at the resident rate or how many individuals may purchase a license for the first time.
