A BILL TO BE ENTITLED
AN ACT to update a federal statutory reference in state law concerning state oversight of fixed GUIDEWAY transit system safety, AS RECOMMENDED BY THE JOINT LEGISLATIVE TRANSPORTATION OVERSIGHT COMMITTEE.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 136‑18(36) reads as rewritten:
"(36) To oversee the safety of fixed guideway transit
systems in the State not regulated by the Federal Railroad Administration,
pursuant to the Intermodal Surface Transportation Efficiency Act of 1991 (49
U.S.C. § 5330).MAP‑21, the Moving Ahead for Progress in the 21st
Century Act (P.L. 112‑141), and any reauthorizations of or amendments to
the Act. The Department shall adopt rules in conformance with 49 U.S.C.
§ 5329 and 49 U.S.C. § 5330 concerning its oversight of the safety of fixed
guideway transit systems."
SECTION 2. This act is effective when it becomes law.
