AN ACT TO REQUIRE THE BOARD OF TRUSTEES OF STATE INSTITUTIONS OF HIGHER LEARNING TO IMMEDIATELY BEGIN A COMPREHENSIVE STUDY OF HOTEL AND RESTAURANT MANAGEMENT DEGREE PROGRAMS AT JACKSON STATE UNIVERSITY; TO AUTHORIZE THE BOARD TO PROMULGATE RULES AND REGULATIONS FOR THE IMPLEMENTATION AND ADMINISTRATION OF SUCH PROGRAM; TO AUTHORIZE THE BOARD TO ENTER INTO CONTRACTS WITH NATIONALLY FRANCHISED HOTEL ESTABLISHMENTS FOR THE CONSTRUCTION AND OPERATION OF A FUNCTIONAL HOTEL ON THE UNIVERSITY CAMPUS TO SERVE AS A BUSINESS LABORATORY FOR STUDENTS ENROLLED IN THE PROGRAM UNDER THE SUPERVISION OF THE OWNERS OF THE HOTEL ESTABLISHMENT; TO PROVIDE THAT JACKSON STATE UNIVERSITY SHALL BE THE INAUGURAL PROGRAM OF THE HOTEL AND RESTAURANT MANAGEMENT PROGRAM, AND SHALL BE THE ONLY STATE INSTITUTION OF HIGHER LEARNING TO PROVIDE SUCH DEGREE PROGRAM FOR A PERIOD OF FOUR YEARS BEFORE THE BOARD EXPANDS THE OFFERING OF SUCH COURSES OF STUDY TO THE REMAINING STATE INSTITUTIONS OF HIGHER LEARNING; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  It shall be the duty of the Board of Trustees of State Institutions of Higher Learning to immediately begin a comprehensive study of hotel and management related programs, degrees and courses available for students enrolled at Jackson State University, and make such adjustments as may be found to be necessary in the programs, to the end that the broadest possible educational opportunities shall be offered to the citizens of this state without inefficient and needless duplication.  Subject to the provisions of Section 2 of this act, the board shall, through its officers and through such procedures as it shall see fit to establish, exercise continuing jurisdiction and control over the establishment of new courses of study, new departments and new functions and activities within the university so that the growth and development of the program of higher education shall proceed in an orderly and rational manner, inefficient and needless duplication may be avoided, and new expanded programs will be undertaken only as the same may become justified, based upon objective criteria to be established by the board.  The board, in conjunction with the president of Jackson State University, shall take such steps as may be necessary to improve and coordinate such programs and shall exercise such direct control over the establishment, organization, operation and granting of credit for such programs as may be necessary to accomplish such purposes.

     SECTION 2.  (1)  Except as otherwise provided in this section, the Board of Trustees of State Institutions of Higher Learning is authorized to regulate all schools or training institutions that provide baccalaureate degree programs in hotel and restaurant management.  No such school shall be located on publicly owned property, other than property under the jurisdiction of Jackson State University, as authorized by the Board of Trustees of State Institutions of Higher Learning.  Except as authorized under this section, no postsecondary education institution shall offer courses of instruction towards the receipt of a baccalaureate degree in hotel and restaurant management.  The hotel and restaurant management educational activities of Jackson State University regulated by the Board of Trustees of State Institutions of Higher Learning shall be deemed to be legal under the laws of the State of Mississippi.

     (2)  The board may adopt regulations it deems necessary to regulate the implementation and administration of such programs of instruction at Jackson State University, and any other state institution of higher learning offering such courses, subject first to the approval of the board.  These regulations shall, without limiting the general powers of the board, include defining the curriculum and entering into contracts with an established nationally franchised hotel chain for the construction and operation of a functional hotel on the campus of the university, which shall be used as a business laboratory operated by enrolled students under the supervision of the university and the owners of the hotel.

     (3)  Within four (4) years after the establishment and implementation of the hotel and restaurant management degree program at Jackson State University, the Board of Trustees of State Institutions of Higher Learning may authorize other state institutions of higher learning to offer credited courses specifically relating to hotel and restaurant management, including, but not limited to, courses that provide instruction in accounting, hospitality, marketing, auditing, finance, procurement, security and regulatory requirements in fulfillment of a degree in general business management, hotel and motel management, food and beverage management or accounting.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2020.
