AN ACT TO AMEND SECTIONS 63-21-63 AND 63-21-64, MISSISSIPPI CODE OF 1972, TO INCREASE THE FEES FOR CERTIFICATES OF TITLE FOR MOTOR VEHICLES, MANUFACTURED HOMES AND MOBILE HOMES; TO AMEND SECTION 63-21-65, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT THE AMOUNT OF THE INCREASE IN THE FEES SHALL BE DEPOSITED INTO THE CRISIS INTERVENTION MENTAL HEALTH FUND; TO AMEND SECTION 41-21-151, MISSISSIPPI CODE OF 1972, TO CONFORM TO THE PRECEDING PROVISION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 63-21-63, Mississippi Code of 1972, is amended as follows:

     63-21-63.  There shall be paid to the Department of Revenue for issuing and processing documents required by this chapter, fees for motor vehicles according to the following schedule:

(a)  Each application for certificate of title issued under Section 63-21-9(2)...................................... $ 20.00

(b)  Each application for certificate of title not issued under Section 63-21-9(2)......................................   16.00

          (c)  Each application for replacement or

corrected certificate of title..........................   16.00

          (d)  Each suspension or revocation of

certificate of title....................................   16.00

(e)  Each notice of security interest.........   16.00

(f)  Each release of security interest........   16.00

(g)  Each assignment by lienholder............   16.00

          (h)  Each application for information as to

the status of the title of a vehicle....................   16.00

     The designated agent may add the sum of Two Dollars ($2.00) to each document processed for which a fee is charged to be retained as his commission for services rendered.  All other fees collected shall be remitted to the Department of Revenue.

     If more than one (1) transaction be involved in any application on a single vehicle and if supported by all required documents, the fee charged by the Department of Revenue and by the designated agent for processing and issuing shall be considered as only one (1) transaction.

     SECTION 2.  Section 63-21-64, Mississippi Code of 1972, is amended as follows:

     63-21-64.  There shall be paid to the Department of Revenue for issuing and processing documents required by this chapter, fees for manufactured homes or mobile homes according to the following schedule:

          (a)  Each application for certificate

of title............................................... $ 20.00

          (b)  Each application for replacement or

corrected certificate of title.........................   20.00

          (c)  Each suspension or revocation of

certificate of title...................................   20.00

(d)  Each notice of security interest.........   20.00

(e)  Each release of security interest........   20.00

(f)  Each assignment by lienholder............   20.00

(g)  Each application for information as to the status of the title of a manufactured home or mobile home.............   20.00

     The designated agent may add the sum of Two Dollars ($2.00) to each document processed for which a fee is charged to be retained as his commission for services rendered.  All other fees collected shall be remitted to the Department of Revenue.

     For each fee collected according to the schedule provided in this section, Four Dollars ($4.00) of each such fee shall be paid to the Department of Revenue to defray the costs of the commission in processing and issuing such documents.  The disposition of fees collected under this section shall be governed by the provisions of this section and not by any other provisions of this chapter.

     If more than one (1) transaction be involved in any application on a single manufactured home or mobile home and if supported by all required documents, the fee charged by the tax commission's designated agent for processing and issuing shall be considered as only one (1) transaction.

     SECTION 3.  Section 63-21-65, Mississippi Code of 1972, is amended as follows:

     63-21-65.  (1)  Except as provided in Section 63-21-64 and in subsection (2) of this section, the Department of Revenue shall pay into the General Fund the fees collected under this chapter.  As much of such fees as authorized by the Legislature shall be used by the Department of Revenue to defray the cost of carrying out the duties of the Department of Revenue, including the maintenance of the automated statewide motor vehicle and manufactured housing registration system.

     (2)  Twelve Dollars ($12.00) of the amount collected under Section 63-21-63(a) through (h) and Section 63-21-64(a) through (g) shall be deposited into the Crisis Intervention Mental Health Fund created in Section 41-21-151.

     SECTION 4.  Section 41-21-151, Mississippi Code of 1972, is amended as follows:

     41-21-151.  There is created in the State Treasury a special interest-bearing fund to be known as the Crisis Intervention Mental Health Fund.  The purpose of the fund shall be to provide funding for the seven (7) mental health crisis centers in the state and the Specialized Treatment Facility for the Emotionally Disturbed located in Harrison County.  Monies from the fund * * * shall be administered and distributed by the State Treasurer upon warrants issued by the Department of Mental Health.  The fund shall be a continuing fund, not subject to fiscal-year limitations, and shall consist of:  (a) monies appropriated by the Legislature for the purposes of funding mental health crisis centers and the Specialized Treatment Facility for the Emotionally Disturbed; (b) the interest accruing to the fund; (c) monies received under the provisions of Section 99-19-73; (d) monies received under the provisions of Section 63-21-65; (e) monies received from the federal government; and (f) monies received from any other sources as may be provided by law.

     SECTION 5.  This act shall take effect and be in force from and after July 1, 2010.
