A BILL FOR AN ACT

 

 

RELATING TO BREASTFEEDING IN THE WORKPLACE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 371, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§371-    Breastfeeding.  An employer shall make reasonable efforts to provide a clean location, other than a bathroom, where an employee may express breastmilk in privacy.  Every employer covered by this section shall post notice, as shall be prescribed by the director, of the application of this section in a conspicuous place accessible to employees.  An employer who violates this section shall be fined $           for each violation.  A civil fine that is ordered pursuant to this section shall be deposited with the director of finance to the credit of the general fund of the State.

     For the purposes of this section, "employer" means any person, including the State or any of its political subdivisions and any agent of such person, having twenty or more employees."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2050.

Description:

Requires an employer with twenty or more employees to make reasonable efforts to provide a clean location for breastfeeding employees to express breast milk in privacy.  Requires covered employers to post a notice pertaining to this provision in a conspicuous location.  Establishes a civil fine for the failure of an employer to provide a location or post notice.  Effective 7/1/50.  (SD1)
