AN ACT
amending Title 41, chapter 6, article 1, Arizona Revised Statutes, by adding section 41-1011.01; relating to administrative procedures.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 41, chapter 6, article 1, Arizona Revised Statutes, is amended by adding section 41-1011.01, to read:
41-1011.01. Review of rules and statutes by agencies
A. At least once every five years, each agency shall review all of its rules and statutory authority that regulate or authorize the regulation of any occupation, profession, activity, use of property, condition or state of affairs and determine whether any of these rules or statutes are obsolete, counterproductive or redundant. For each rule or statute, the agency shall consider the following criteria:
1. Whether the problem addressed by the rule or statute currently exists or is likely to recur.
2. Whether the resources used to enforce the rule or statute could be used more effectively and efficiently to achieve the same purposes in support of any other rule or statute.
3. Whether market forces or other existing common laws, rules or statutes are sufficient, absent the rule or statute, to reasonably reduce the threat posed to public health, safety or general welfare by the targeted activity or condition.
B. An agency shall complete the review within ninety days after it commences. Within thirty days after completion, the agency shall submit a report regarding its findings to the governor, the president of the senate and the speaker of the house of representatives and provide a copy of this report to the secretary of state. The agency shall make copies of the report for the public on request.
