SENATE BILL NO. 13 AMENDMENT IN THE NATURE OF A SUBSTITUTE (Proposed by the Senate Committee on Education and Health on January 18, 2024) (Patron Prior to Substitute--Senator Favola) A BILL to amend the Code of Virginia by adding a section numbered 15.2-2292.2, relating to early childhood care and education; child day programs; use of office buildings; waiver of zoning requirements.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 15.2-2292.2 as follows:

§15.2-2292.2. Waiver of zoning permit requirements; child day programs.

Any locality may provide by ordinance for the waiver of any requirements for zoning permits for the operation of a child day program in an office building, defined as any building containing more than two rental units that are rented primarily for retail, commercial, or professional use, provided that such facility satisfies the requirements for state licensure as a child day program.
