A BILL TO BE ENTITLED
 
AN ACT
  relating to the creation of the criminal offense of a peace officer
  making a false statement in an incident report.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 39, Penal Code, is amended by adding
  Section 39.08 to read as follows:
         Sec. 39.08.  FALSE STATEMENT IN INCIDENT REPORT. (a)  A
  peace officer commits an offense if the officer:
               (1)  files a report with the law enforcement agency
  employing the officer regarding the commission or investigation of
  an offense; and
               (2)  intentionally or knowingly makes a false statement
  in the report.
         (b)  An offense under this section is a Class A misdemeanor.
         (c)  It is an exception to the application of this section
  that the peace officer attributes the false statement to another
  person in the report.
         SECTION 2.  This Act takes effect September 1, 2021.
