relating to the creation of the criminal offense of a peace officer | ||
making a false statement in an incident report. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 39, Penal Code, is amended by adding | ||
Section 39.08 to read as follows: | ||
Sec. 39.08. FALSE STATEMENT IN INCIDENT REPORT. (a) A | ||
peace officer commits an offense if the officer: | ||
(1) files a report with the law enforcement agency | ||
employing the officer regarding the commission or investigation of | ||
an offense; and | ||
(2) intentionally or knowingly makes a false statement | ||
in the report. | ||
(b) An offense under this section is a Class A misdemeanor. | ||
(c) It is an exception to the application of this section | ||
that the peace officer attributes the false statement to another | ||
person in the report. | ||
SECTION 2. This Act takes effect September 1, 2021. |
