AN ACT

Providing for continuation of adultBasic Act, for the authority

2

of the Insurance Commissioner to transfer funds and for

3

repayment of funds; and making a related repeal.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Short title.

7

This act shall be known and may be cited as the Continuation

8

of adultBasic Act.

9

Section 2.  Findings.

10

The General Assembly finds and declares that:

11

(1)  The adultBasic program was established by the act of

12

June 26, 2001 (P.L.755, No.77), known as the Tobacco

13

Settlement Act and provides insurance coverage for the basic

health care needs of individuals between 19 and 64 years of

2

age who do not have health insurance and who do not have

3

income in excess of 200% of the Federal poverty level. 

4

(2)  At the present time there are more than 40,000

5

Pennsylvanians enrolled in the adultBasic program and another

6

450,000 individuals are on the wait list to obtain coverage.

7

(3)  The adultBasic program has provided health insurance

8

for thousands of Pennsylvanians and thus provided them with

9

access to quality health care.

10

(4)  Funding for the adultBasic program has been provided

11

through the national Tobacco Settlement Agreement and the

12

Community Health Reinvestment Agreement, an agreement under

13

which the Blue Cross and Blue Shield Plans contributed a

14

percentage of their premiums to the adultBasic program. 

15

(5)  The Community Health Reinvestment Agreement expired

16

on December 31, 2010, creating a shortfall of revenues with

17

which to continue adultBasic coverage for more than 40,000

18

individuals through June of this year.

19

(6)  Absent the identification and implementation of

20

another funding source, the 40,000 Pennsylvanians currently

21

enrolled in the adultBasic program will lose their health

22

insurance coverage.

Section 3.  Definitions.

24

The following words and phrases when used in this act shall

25

have the meanings given to them in this section unless the

26

context clearly indicates otherwise:

27

"AdultBasic program."  The program established under Chapter

28

13 of the act of June 26, 2001 (P.L.755, No.77), known as the

29

Tobacco Settlement Act.

30

"Commissioner."  The Insurance Commissioner of the

Commonwealth.

Section 4.  Transfer of funds.

(a)  Authority.--The commissioner may transfer sufficient

4

funds from the Catastrophic Loss Benefits Continuation Fund, or

5

another fund under his administration and management which may

6

be appropriate, as is necessary to continue the adultBasic

7

program through June 30, 2011. 

8

(b)  Repayment.--A transfer made under this subsection shall

9

be repaid with interest under section 2 of the act of August 22,

10

1961 (P.L.1049, No.479), entitled "An act authorizing the State

11

Treasurer under certain conditions to transfer sums of money

12

between the General Fund and certain funds and subsequent

13

transfers of equal sums between such funds, and making

14

appropriations necessary to effect such transfers."

15

Section 5.  Funding.

16

Notwithstanding the provisions of 75 Pa.C.S. § 6506(b)

17

(relating to surcharge) or section 712(m) of the act of March

18

20, 2002 (P.L.154, No.13), known as the Medical Care

19

Availability and Reduction of Error (Mcare) Act, beginning July

20

1, 2011, surcharges levied and collected under 75 Pa.C.S. §

21

6506(a) by a division of the unified judicial system shall be

22

remitted to the Commonwealth, and shall be used to repay loans

23

made from the fund selected by the commissioner under this act

24

to continue the adultBasic program during fiscal year 2010-2011.

25

Thereafter, and once all loans have been repaid, the surcharges

26

levied and collected under 75 Pa.C.S. § 6506(a) shall be

27

deposited into the General Fund.

28

Section 19.  Repeals are as follows:

29

(1)  The General Assembly declares that the repeal under

30

paragraph (2) is necessary to effectuate this act.

(2)  Section 712(m) of the act of March 20, 2002

2

(P.L.154, No.13), known as the Medical Care Availability and

3

Reduction of Error (Mcare) Act is repealed.

4

Section 20.  Effective date.

5

This act shall take effect immediately.
