Bill Title: Directs the police commissioner of the city of New York to assign a police officer at least one hour prior to the commencement of instructional hours at every school, public and/or private, within the city of New York (Part A); and establishes active shooter drills at public and private educational institutions (Part B); relates to photo speed violation monitoring systems in school speed zones in the city of New York; makes technical corrections relating to photo speed violation monitoring systems in school speed zones in the city of New York; and relates to the effectiveness of provisions of law relating to establishing in a city with a population of one million or more a school speed zones by means of photo devices (Part C); relates to establishing a temporary high-occupancy vehicle program on the Williamsburg bridge by means of mobile or stationary photo devices (Part D).

        Introduced  by  Sen.  FELDER -- read twice and ordered printed, and when
          printed to be committed to the Committee on Cities
        AN ACT to amend the administrative code of the  city  of  New  York,  in
          relation  to  school safety measures in the city of New York (Part A);
          and to amend the education law, in  relation  to  establishing  active
          shooter  drills  at  public and private educational institutions (Part
          B);
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section 1. This act enacts into law components of legislation relating
     2  to school safety. Each component is wholly contained within a Part iden-
     3  tified  as  Parts  A  through  B. The effective date for each particular
     4  provision contained within such Part is set forth in the last section of
     5  such Part. Any provision in any section contained within a Part, includ-
     6  ing the effective date of the Part, which makes a reference to a section
     7  "of this act", when used in connection with that  particular  component,
     8  shall  be  deemed  to mean and refer to the corresponding section of the
     9  Part in which it is found. Section three of  this  act  sets  forth  the
    10  general effective date of this act.
    11                                   PART A
    12    Section  1. The administrative code of the city of New York is amended
    13  by adding a new section 10-179 to read as follows:
    14    § 10-179 School safety measures. The police commissioner of  the  city
    15  shall  assign  a police officer at least one hour prior to the commence-
    16  ment of instructional hours at  every  school,  public  and/or  private,
    17  within the city of New York. Such police officer shall remain on site at
    18  such  school  during instructional hours and for a minimum one hour post
    19  instructional hours unless, in the discretion of the mayor of  the  city
    20  or  the  police  commissioner  of  the city, a state of emergency exists
    21  requiring redeployment of a police officer during the required hours set
    22  forth in this section.
    23    § 2. This act shall take effect immediately.

     1                                   PART B
     2    Section  1.  Subdivision  1  of  section  807 of the education law, as
     3  amended by section 2 of part B of chapter 54 of the  laws  of  2016,  is
     4  amended to read as follows:
     5    1.  It shall be the duty of the principal or other person in charge of
     6  every public or private school or  educational  institution  within  the
     7  state,  other  than  colleges or universities, to instruct and train the
     8  pupils by means of drills, so that they may in  a  sudden  emergency  be
     9  able  to respond appropriately in the shortest possible time and without
    10  confusion or panic. Such drills shall be held at least twelve  times  in
    11  each  school  year, eight of which required drills shall be held between
    12  September first and December thirty-first of each such  year.  Eight  of
    13  all  such  drills  shall  be  evacuation  drills, four of which shall be
    14  through use of the fire escapes on  buildings  where  fire  escapes  are
    15  provided  or  through  the  use of identified secondary means of egress.
    16  Four of all such required drills shall be emergency attack drills,  with
    17  two  of  such drills being lock-down drills and two of such drills being
    18  active shooter drills. Upon request of the principal or other person  in
    19  charge  of  such public or private educational institution, the New York
    20  state school safety improvement teams, established pursuant  to  section
    21  twenty-eight  hundred  one-b  of this chapter, shall provide recommenda-
    22  tions on how to perform such lock-down and active shooter drills at such
    23  public or private educational institution.  Drills shall be conducted at
    24  different times of the school day. Pupils shall  be  instructed  in  the
    25  procedure  to  be  followed  in  the event that a fire occurs during the
    26  lunch  period  or  assembly,  provided  however,  that  such  additional
    27  instruction  may  be  waived  where  a  drill is held during the regular
    28  school lunch period or assembly. Four additional drills shall be held in
    29  each school year during the hours after sunset  and  before  sunrise  in
    30  school  buildings  in which students are provided with sleeping accommo-
    31  dations. At least two additional drills  shall  be  held  during  summer
    32  school  in  buildings  where summer school is conducted, and one of such
    33  drills shall be held during the first week of summer school.
    34    § 2. This act shall take effect immediately.
    35    § 2. Severability. If any clause,  sentence,  paragraph,  subdivision,
    36  section  or part of this act shall be adjudged by any court of competent
    37  jurisdiction to be invalid, such judgment shall not affect,  impair,  or
    38  invalidate the remainder thereof, but shall be confined in its operation
    39  to the clause, sentence, paragraph, subdivision, section or part thereof
    40  directly  involved  in the controversy in which such judgment shall have
    41  been rendered. It is hereby declared to be the intent of the legislature
    42  that this act would have been enacted even if  such  invalid  provisions
    43  had not been included herein.
    44    §  3.  This act shall take effect immediately; provided, however, that
    45  the applicable effective date of Parts A through B of this act shall  be
    46  as specifically set forth in the last section of such Parts.
