STATE OF NEW YORK ________________________________________________________________________ 7249 2023-2024 Regular Sessions IN SENATE May 19, 2023 ___________ Introduced by Sen. COONEY -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Homeland Securi- ty and Military Affairs AN ACT in relation to requiring a place of entertainment to establish emergency preparedness plans The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Emergency preparedness plans. 1. a. Any place of enter- 2 tainment, as such term is defined in section 25.03 of the arts and 3 cultural affairs law, that is open for use and can hold at least one 4 thousand people shall submit to the municipality in which such place of 5 entertainment is located an emergency preparedness plan. For purposes of 6 this section, "emergency preparedness plan" shall mean any fire safety 7 or evacuation plan required by the most recent fire code adopted by the 8 state. 9 b. Such emergency preparedness plan shall be submitted to the munici- 10 pality on an annual basis. The municipality shall approve or reject such 11 plan. Any place of entertainment subject to the provisions of this act 12 that fails to submit such plan shall not host events until such plan is 13 submitted and approved. If a municipality fails to approve or reject 14 such plan within thirty days it shall be deemed approved. 15 c. Any place of entertainment subject to the provisions of this 16 section that fails to submit such plan shall also be subject to a fine 17 of one thousand dollars for the first violation and five thousand 18 dollars for each subsequent offense. Such fine is to be paid to the 19 municipality in which such place of entertainment is located. 20 2. Any place of entertainment, as such term is defined in section 21 25.03 of the arts and cultural affairs law, that is open for use shall 22 make all emergency announcements as required by the most recent fire 23 code adopted by the state. Any place of entertainment subject to the 24 provisions of this section that fails to make such required emergency EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD11553-01-3S. 7249 2 1 announcements shall be subject to a fine of five hundred dollars for the 2 first violation and one thousand dollars for each subsequent offense. 3 Such fine is to be paid to the municipality in which such place of 4 entertainment is located. 5 § 2. The commissioner of the division of homeland security and emer- 6 gency services is hereby authorized to promulgate any rules and regu- 7 lations necessary to carry out the provisions of this act. 8 § 3. This act shall take effect immediately.
