Bill Title: Relates to the provision of off-site health care services; directs the commissioner of health to allow diagnostic and treatment centers and outpatient clinics of general hospitals to provide off-site services to existing patients who are chronically ill and temporarily or permanently homebound at their residence or a long term care facility.

       Introduced  by  Sen.  HANNON -- read twice and ordered printed, and when
         printed to be committed to the Committee on Health
       AN ACT to amend the public health law, in relation to the  provision  of
         offsite health care services
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 2803 of the public health law is amended by  adding
    2  a new subdivision 11 to read as follows:
    3    11.  NOTWITHSTANDING  ANY  PROVISION OF LAW, RULE OR REGULATION TO THE
    4  CONTRARY, THE COMMISSIONER SHALL ALLOW DIAGNOSTIC AND TREATMENT  CENTERS
    5  AND  OUTPATIENT CLINICS OF GENERAL HOSPITALS TO PROVIDE OFFSITE SERVICES
    6  TO EXISTING PATIENTS WHO ARE CHRONICALLY ILL AND TEMPORARILY  OR  PERMA-
    7  NENTLY  HOMEBOUND  AT  THEIR RESIDENCE, INCLUDING THOSE RESIDING IN LONG
    8  TERM CARE SETTINGS THAT ARE DEFINED AS OR  CONSIDERED  THE  INDIVIDUAL'S
    9  RESIDENCE.  SUCH  PATIENTS  SHALL  BE  IN  NEED OF PROFESSIONAL SERVICES
   10  AVAILABLE AT THE DIAGNOSTIC AND TREATMENT  CENTER  OR  GENERAL  HOSPITAL
   11  OUTPATIENT  CLINIC,  BUT,  DUE TO THE INDIVIDUAL'S MEDICAL CONDITION, BE
   12  UNABLE TO RECEIVE ON-SITE  SERVICES  AT  THE  DIAGNOSTIC  AND  TREATMENT
   13  CENTER OR GENERAL HOSPITAL OUTPATIENT CLINIC.
   14    S 2. This act shall take effect on the one hundred twentieth day after
   15  it shall have become a law.
