Bill Title: Relates to the provision of off-site health care services; directs the commissioner of health to allow diagnostic and treatment centers and outpatient clinics of general hospitals to provide off-site services to existing patients who are chronically ill and temporarily or permanently homebound at their residence or a long term care facility.

       Introduced  by  Sens.  HANNON, LARKIN -- read twice and ordered printed,
         and when printed to  be  committed  to  the  Committee  on  Health  --
         reported  favorably  from  said committee, ordered to first and second
         report, ordered to a third reading,  amended  and  ordered  reprinted,
         retaining its place in the order of third reading -- again amended and

       AN  ACT  to amend the public health law, in relation to the provision of
         off-site health care services
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Section 2803 of the public health law is amended by adding
    2  a new subdivision 11 to read as follows:
    3    11. NOTWITHSTANDING ANY PROVISION OF THIS  ARTICLE,  OR  ANY  RULE  OR
    4  REGULATION  UNDER  THIS  ARTICLE TO THE CONTRARY, THE COMMISSIONER SHALL
    5  ALLOW DIAGNOSTIC AND TREATMENT CENTERS AND OUTPATIENT CLINICS OF GENERAL
    6  HOSPITALS TO PROVIDE OFF-SITE SERVICES  TO  EXISTING  PATIENTS  WHO  ARE
    7  CHRONICALLY  ILL AND TEMPORARILY OR PERMANENTLY HOMEBOUND AT THEIR RESI-
    8  DENCE, INCLUDING THOSE RESIDING IN LONG  TERM  CARE  SETTINGS  THAT  ARE
    9  DEFINED AS OR CONSIDERED THE INDIVIDUAL'S RESIDENCE. SUCH PATIENTS SHALL
   10  BE  IN  NEED  OF  PROFESSIONAL  SERVICES AVAILABLE AT THE DIAGNOSTIC AND
   11  TREATMENT CENTER OR GENERAL HOSPITAL OUTPATIENT CLINIC, BUT, DUE TO  THE
   12  INDIVIDUAL'S MEDICAL CONDITION, BE UNABLE TO RECEIVE ON-SITE SERVICES AT
   13  THE DIAGNOSTIC AND TREATMENT CENTER OR GENERAL HOSPITAL OUTPATIENT CLIN-
   14  IC.   SERVICES PROVIDED OFF-SITE UNDER THIS SUBDIVISION SHALL BE LIMITED
   15  TO THOSE SERVICES OTHERWISE AUTHORIZED TO BE  PROVIDED  ON-SITE  BY  THE
   16  DIAGNOSTIC AND TREATMENT CENTER OR OUTPATIENT CLINIC.
   17    S 2. This act shall take effect on the one hundred twentieth day after
   18  it shall have become a law.
