          printed to be committed to the Committee on Social Services

        AN ACT to amend the social services law, in relation to  increasing  the
          state reimbursement rate for preventative child protective services

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Paragraph (a) of subdivision 1  of  section  153-k  of  the
     2  social  services  law, as added by section 15 of part C of chapter 83 of
     3  the laws of 2002, is amended to read as follows:
     4    (a) Expenditures made by social services districts for  child  protec-
     5  tive  services, preventive services provided, as applicable, to eligible
     6  children and families of children who are in  and  out  of  foster  care
     7  placement, independent living services, aftercare services, and adoption
     8  administration  and  services  other  than  adoption  subsidies provided
     9  pursuant to article six of this  chapter  and  the  regulations  of  the
    10  department  of  family  assistance  shall,  if approved by the office of
    11  children and family services, be subject  to  [sixty-five]  seventy-five
    12  percent  state  reimbursement exclusive of any federal funds made avail-
    13  able for such purposes, in accordance with the directives of the depart-
    14  ment of family assistance and subject to the approval of the director of
    15  the budget.
    16    § 2. This act shall take effect immediately; provided,  however,  that
    17  the amendments to paragraph (a) of subdivision 1 of section 153-k of the
    18  social services law made by section one of this act shall not affect the
    19  repeal of such section and shall be deemed repealed therewith.
