STATE OF NEW YORK ________________________________________________________________________ 5015 2023-2024 Regular Sessions IN SENATE February 21, 2023 ___________ Introduced by Sen. GOUNARDES -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to amend the civil service law, in relation to the appointment and promotion of certain personnel of the sanitation department of the city of New York The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The civil service law is amended by adding a new section 2 59-e to read as follows: 3 § 59-e. Promotions of certain personnel of the sanitation department 4 of the city of New York. 1. The legislature hereby finds and declares 5 that the continued, uninterrupted, adequate and efficient operation of 6 the sanitation department of the city of New York is necessary for the 7 general welfare of the people; that such adequate operation involves and 8 requires personnel with highly specialized ability, skill, training and 9 knowledge, which necessitate that vacancies in the sanitation department 10 of the city of New York in the positions of General Superintendent 2 and 11 General Superintendent 3, shall be filled as far as practicable by 12 promotion from among persons holding competitive class positions in a 13 lower grade in the sanitation department of the city of New York in 14 which the vacancy exists, provided that such lower grade positions are 15 in direct line of promotion, as determined by such sanitation department 16 or the municipal commission. 17 2. Promotion shall be based on merit and fitness as determined by 18 competitive examination, due weight being given to seniority. The previ- 19 ous training and experience of the candidates, and performance ratings 20 where available, may be considered and given due weight as factors in 21 determining the relative merit and fitness of candidates for promotion. 22 3. Except as provided above, the provisions of this chapter shall 4 apply to employees covered by this section. 5 § 2. This act shall take effect immediately.
