GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Cities AN ACT to amend the administrative code of the city of New York, in relation to school zone speed limits and signage and other traffic calming devices THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision a of section 19-177 of the administrative code 2 of the city of New York, as added by local law number 6 of the city of 3 New York for the year 1996, is amended and a new subdivision d is added 4 to read as follows: 5 a. The official speed limit for a vehicle in the city of New York 6 shall be thirty miles per hour, EXCEPT THAT SCHOOL SPEED LIMITS MAY BE 7 ESTABLISHED AT NOT LESS THAN FIFTEEN MILES PER HOUR, FOR A DISTANCE NOT 8 TO EXCEED ONE THOUSAND THREE HUNDRED TWENTY FEET, ON A HIGHWAY PASSING A 9 SCHOOL BUILDING, ENTRANCE OR EXIT OF A SCHOOL ABUTTING ON THE HIGHWAY, 10 OR except where an official sign indicates that a different speed limit 11 is in effect. 12 D. THE COMMISSIONER SHALL POST AT EACH PUBLIC AND NON-PUBLIC SCHOOL, 13 SCHOOL ZONE SPEED LIMIT SIGNS. NO PERSON SHALL DRIVE IN EXCESS OF SUCH 14 MAXIMUM SCHOOL SPEED LIMITS DURING: 15 1. SCHOOL DAYS AT TIMES INDICATED ON THE SCHOOL ZONE SPEED LIMIT SIGN, 16 PROVIDED, HOWEVER, THAT SUCH TIMES SHALL BE BETWEEN THE HOURS OF SEVEN 17 O'CLOCK A.M. AND SIX O'CLOCK P.M. OR ALTERNATIVE TIMES WITHIN SUCH 18 HOURS; OR 19 2. A PERIOD WHEN THE BEACONS ATTACHED TO THE SCHOOL ZONE SPEED LIMIT 20 SIGN ARE FLASHING AND SUCH SIGN IS EQUIPPED WITH A NOTICE THAT INDICATES 21 THAT THE SCHOOL ZONE SPEED LIMIT IS IN EFFECT WHEN SUCH BEACONS ARE 22 FLASHING, PROVIDED, HOWEVER, THAT SUCH BEACONS SHALL ONLY FLASH DURING 23 STUDENT ACTIVITIES AT THE SCHOOL AND UP TO THIRTY MINUTES IMMEDIATELY EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10132-02-3 S. 4613 2 1 BEFORE AND UP TO THIRTY MINUTES IMMEDIATELY AFTER SUCH STUDENT ACTIV- 2 ITIES. 3 S 2. Paragraph 3 of subdivision a and subdivision b of section 19-183 4 of the administrative code of the city of New York, as added by local 5 law number 64 of the city of New York for the year 2010, are amended and 6 two new subdivisions c and d are added to read as follows: 7 3. "Traffic calming device" shall mean any device, not governed by the 8 manual on uniform traffic control devices, including, but not limited 9 to, speed humps, curb extensions, traffic diverters, FLASHING BEACONS, 10 median barriers and raised walkways, installed on a street and intended 11 to slow, reduce or alter motor vehicle traffic to improve safety for 12 pedestrians and bicyclists. 13 b. The department shall establish guidelines governing the approval 14 and placement of traffic calming devices. Such guidelines shall consider 15 whether such traffic calming devices would be installed [adjacent to a 16 school or] in a location where a high percentage of seniors use the 17 streets, such as locations adjacent to senior centers and nursing homes, 18 and any other locations as determined by the department. Such guidelines 19 shall list the conditions under which installation of such traffic calm- 20 ing device may be appropriate. Such guidelines shall be distributed to 21 any entity upon request and shall be published on the department's 22 website. 23 C. THE DEPARTMENT SHALL INSTALL AND MAINTAIN TRAFFIC CALMING DEVICES 24 ADJACENT TO SCHOOLS AND ANY OTHER LOCATIONS AS DETERMINED BY THE DEPART- 25 MENT FOR STUDENT SAFETY. 26 D. NOT LATER THAN MARCH FIRST OF EACH YEAR, THE COMMISSIONER SHALL 27 TRANSMIT TO THE MAYOR AND THE CITY COUNCIL A REPORT SETTING FORTH, WITH 28 RESPECT TO THE PRIOR CALENDAR YEAR, THE FOLLOWING INFORMATION: 29 1. THE LOCATION OF EACH SCHOOL SPEED LIMIT ZONE SIGN; 30 2. THE NUMBER OF CITATIONS ISSUED FOR SPEED VIOLATIONS IN EACH SUCH 31 SPEED ZONE; 32 3. THE EFFECT THAT SUCH SCHOOL SPEED LIMIT ZONE SIGNS HAVE ON THE 33 NUMBER OF CITATIONS ISSUED AND NUMBER OF ACCIDENTS OCCURRING WITHIN EACH 34 SUCH ZONE; PROVIDED THAT SUCH EFFECT SHALL INCLUDE STATISTICS REGARDING 35 THE CITATIONS ISSUED AND ACCIDENTS FOR EACH SPEED ZONE DURING THE IMME- 36 DIATELY PRIOR CALENDAR YEAR; AND 37 4. THE EFFECT THAT SUCH SCHOOL SPEED ZONES HAVE ON THE TRAFFIC FLOW 38 AND SPEED VIOLATIONS IN AREAS OUTSIDE THE SCHOOL SPEED LIMIT ZONES. 39 S 3. This act shall take effect on the one hundred eightieth day after 40 it shall have become a law. Effective immediately, the addition, amend- 41 ment and/or repeal of any rule or regulation necessary for the implemen- 42 tation of this act on its effective date are authorized to be made and 43 completed on or before such effective date.
