STATE OF NEW YORK ________________________________________________________________________ 4160--A 2019-2020 Regular Sessions IN SENATE March 1, 2019 ___________ Introduced by Sen. LITTLE -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend chapter 491 of the laws of 2018 relating to incorporat- ing the Volunteer Exempt Firefighter's Benevolent Association of Whitehall, New York and providing for its powers and duties, in relation to the disposition of foreign fire insurance premium taxes received by such corporation The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 7 of chapter 491 of the laws of 2018 relating to 2 incorporating the Volunteer Exempt Firefighter's Benevolent Association 3 of Whitehall, New York and providing for its powers and duties, is 4 amended to read as follows: 5 § 7. Precept for payment of foreign fire insurance premium taxes. Such 6 corporation shall collect and there shall be paid to it all taxes 7 imposed by [article 91] section 9104 of the insurance law for fire 8 department use and benefit, upon premiums for insurance against loss or 9 damage by fire covering property situated in the Whitehall fire 10 protection district, in the town of Whitehall and county of Washington, 11 or within any duly organized territory in which the Whitehall Volunteer 12 Fire Company, Inc. is or may be obligated to render fire protection. The 13 officer of said corporation designated by its by-laws to collect and 14 receive the aforesaid tax shall have all the powers and be subject to 15 all the provisions of the insurance law, relating to treasurers of fire 16 departments. Such corporation shall also be entitled to receive a share 17 of the tax imposed by [article 91] section 9105 of the insurance law, 18 based upon the business written in the territory with respect to which 19 it is entitled to collect and receive the tax under [article 91] section 20 9104 of the insurance law. This act shall take effect immediately.
