       IN  SENATE -- Introduced by Sen. BALL -- read twice and ordered printed,
         and when printed to be committed to the Committee on Local Government

       AN  ACT  to  authorize  the  town  of Yorktown, county of Westchester to
         alienate and convey certain parcels of land used as park land
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  The  town  of  Yorktown, county of Westchester, is hereby
    2  authorized to discontinue as park lands, alienate and convey  the  lands
    3  described in section three of this act.
    4    S  2.  The  authorization provided in section one of this act shall be
    5  subject to the requirement that the  town  of  Yorktown  shall  use  any
    6  proceeds  and/or land received in exchange for the conveyance authorized
    7  by this act to acquire land, to be dedicated for park  purposes,  in  an
    8  amount  equal to or greater than the fair market value of the land being
    9  conveyed pursuant to this act and/or used for  capital  improvements  to
   10  existing park and recreational facilities.
   11    S  3. The land authorized to be discontinued as park land and conveyed
   12  is as follows:
   13    All that certain plot, piece or parcel of land, lying and being at the
   14  town of Yorktown, Westchester County and State of New York, described as
   15  follows:
   16    Parcel A carrying tax identification number 25.20-1-8;
   17    Parcel B carrying tax identification number 25.16-1-25;
   18    Parcel C carrying tax identification number 26.13-1-1;
   19    Parcel D carrying tax identification number 26.13-1-1.1; and
   20    Parcel E carrying tax identification number 26.09-1-22.
   21    Parcels A, B, C and D may be alienated and conveyed for a  period  not
   22  to  exceed three years after which such land shall revert to the town of
   23  Yorktown. Parcel E may be alienated and conveyed permanently.
   24    S 4. If the land that is the subject of this act has received  funding
   25  pursuant to the federal land and water conservation fund, the discontin-

    1  uance  of  park lands authorized by the provisions of this act shall not
    2  occur until the municipality has complied with the federal  requirements
    3  pertaining  to  the  conversion  of park lands, including satisfying the
    4  secretary  of  the  interior  that  the  discontinuance will include all
    5  conditions which the secretary of the interior deems necessary to assure
    6  the substitution of other lands shall be equivalent in fair market value
    7  and recreational usefulness to the lands being discontinued.
    8    S 5. This act shall take effect immediately.
