STATE OF NEW YORK ________________________________________________________________________ 8531 IN ASSEMBLY January 5, 2024 ___________ Introduced by M. of A. SAYEGH -- read once and referred to the Committee on Corporations, Authorities and Commissions AN ACT to amend the public service law, in relation to the emergency response plans relating to downed wires and prioritizing the securing of such wires The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subparagraphs (xi), (xii) and (xiii) of paragraph (a) of 2 subdivision 21 of section 66 of the public service law, subparagraph 3 (xi) as amended by a chapter of the laws of 2023 amending the public 4 service law relating to the emergency response plans relating to downed 5 wires, as proposed in legislative bills numbers S. 7230 and A. 237, and 6 subparagraphs (xii) and (xiii) as separately amended by chapters 395 and 7 743 of the laws of 2022, are amended to read as follows: 8 (xi) appropriate safety precautions regarding electrical hazards, 9 including plans to promptly secure downed wires within thirty-six hours 10 of notification of the location of such downed wires from a municipal 11 emergency official [or individual]; (xii) plans to prioritize the secur- 12 ing of downed wires over routine maintenance or other work unrelated to 13 a response to an emergency event after notification by an individual of 14 the location of such downed wires and where such notification includes 15 information indicating wire burning, arcing/sparking, or the restriction 16 of ingress and egress from a building or vehicle, or other immediate 17 hazards. Such plans shall, at minimum, include procedures to identify, 18 locate, and assess the reported wire no later than seventy-two hours 19 after the response to an emergency event ends; (xiii) plans setting 20 forth how the communication and coordination of efforts between the 21 electric corporation, electric corporation employees, electric corpo- 22 ration company crews, mutual aid crews, other utilities, local govern- 23 ments and any other entity performing services to assist such electric 24 corporation shall occur; and [(xiii)] (xiv) such other additional infor- 25 mation as the commission may require. 26 § 2. This act shall take effect on the same date and in the same 27 manner as a chapter of the laws of 2023 amending the public service law 28 relating to the emergency response plans relating to downed wires, as 29 proposed in legislative bills numbers S. 7230 and A. 237, takes effect.
