        Introduced  by  M. of A. BURDICK, LEVENBERG -- read once and referred to
          the Committee on Governmental Operations -- recommitted to the Commit-
          tee on Governmental Operations in accordance  with  Assembly  Rule  3,
          sec.  2  --  committee  discharged, bill amended, ordered reprinted as
          amended and recommitted to said committee

        AN ACT to amend the civil rights law, in relation to enacting the "trav-
          eling with dignity act"

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Short  title. This act shall be known and may be cited as
     2  the "traveling with dignity act".
     3    § 2. The civil rights law is amended by adding a new section  79-r  to
     4  read as follows:
     5    §  79-r.  Adult changing accommodations.   1. As used in this section,
     6  the following terms shall have the following meanings:
     7    (a) "Adult changing accommodation"  means  a  height-adjustable  adult
     8  changing  table  placed  within  an  enclosed restroom facility or other
     9  similar private facility that is for use by  persons  with  disabilities
    10  who need help with diapering.
    11    (b)  "Commercial  place  of  public  amusement"  means  an auditorium,
    12  convention center, cultural complex, exhibition hall,  permanent  amuse-
    13  ment park, sports arena, or theater or movie house for which the maximum
    14  occupancy is determined to be two thousand five hundred or more people.
    15    (c)  "Covered  facility" means a commercial place of public amusement,
    16  public roadside rest  area  with  sanitary  facilities,  museum,  public
    17  library or other public building.
    18    (d) "Disability" shall have the same meaning as provided for in subdi-
    19  vision  twenty-one  of  section  two hundred ninety-two of the executive
    20  law.
    21    (e) "Public building" means a public building owned by  the  state  of
    22  New  York,  under  the  supervision  and  control of the commissioner of

     1  general services, that is determined by such commissioner to be open  to
     2  the public.
     3    2.  (a)  A  covered  facility  shall install and maintain at least one
     4  adult changing accommodation for persons with a physical disability that
     5  is accessible to both men and women when the facility  is  open  to  the
     6  public, if any of the following occur:
     7    (i)  The  covered  facility  is  newly constructed on or after January
     8  first, two thousand twenty-five;
     9    (ii) When an existing covered facility is renovated on or after  Janu-
    10  ary first, two thousand twenty-five, and either requires a permit or the
    11  estimated cost of the renovation is ten thousand dollars or more; or
    12    (iii)  If neither subparagraph (i) or (ii) of this paragraph apply, in
    13  the case of:
    14    (1) a covered facility that is a public building, no later than  Janu-
    15  ary first, two thousand twenty-eight;
    16    (2)  a  covered  facility that is a museum or public library, no later
    17  than January first, two thousand thirty; or
    18    (3) a covered facility that is a commercial place of public amusement,
    19  no later than January first, two thousand thirty-two; or
    20    (b) A covered facility with an enclosed  restroom  facility  or  other
    21  similar  private  facility  with  an  adult changing table in use before
    22  January first, two thousand twenty-five, shall be deemed to comply  with
    23  this subdivision.
    24    3.  A  covered  facility  shall ensure that the entrance to each adult
    25  changing accommodation has conspicuous signage indicating  the  location
    26  of  the  accommodation,  and,  if  the facility has a central directory,
    27  shall ensure that the central directory indicates the  location  of  the
    28  adult changing accommodation.
    29    § 3. This act shall take effect immediately.
