Bill Title: Expands the purposes of the South Salem Exempt Volunteer Firemen's Benevolent Association to be to promote friendly association for the betterment of the members of the corporation; provide relief, aid and assistance to those members and their families who are injured, disabled or indigent; provide for the health and safety of the members of the corporation; maintain suitable headquarters for the members of the corporation; promote and safeguard the welfare of the members of the corporation; enhance the morale of the members of the corporation by providing social and recreational activities for members of the association; and promote the volunteer fire service within the territory now served or which may hereafter be served by the South Salem Fire Department, Inc.; relates to certain foreign fire insurance premium taxes.

BURDICK -- read once and referred to the Commit- tee on Local Governments -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend chapter 538 of the laws of 1975 incorporating the South Salem Exempt Volunteer Firemen's Benevolent Association, and providing for its powers and duties, in relation to the purposes of the South Salem Exempt Volunteer Firemen's Benevolent Association and to foreign fire insurance premium taxes The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Sections 3 and 7 of chapter 538 of the laws of 1975 incor- 2 porating the South Salem Exempt Volunteer Firemen's Benevolent Associ- 3 ation, and providing for its powers and duties, are amended to read as 4 follows: 5 § 3. Purposes. The purposes of such corporation shall be [the mainte-6nance of suitable headquarters for, and the promotion of fraternal7intercourse among the members of such corporation, the relief, aid and8assistance of such members and their families who are disabled or indi-9gent, and the promotion of the welfare of the volunteer fire service10within the South Salem Fire District and, if any, the territory provided11with fire protection by contract with such fire district.] to (a) 12 promote friendly association for the betterment of the members of the 13 corporation; (b) provide relief, aid and assistance to those members and 14 their families who are injured, disabled or indigent; (c) provide for 15 the health and safety of the members of the corporation; (d) maintain 16 suitable headquarters for the members of the corporation; (e) promote 17 and safeguard the welfare of the members of the corporation; (f) enhance 18 the morale of the members of the corporation by providing social and 19 recreational activities for members of the association; and (g) promote 20 the volunteer fire service within the territory now served or which may 21 hereafter be served by the South Salem Fire Department, Inc. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD10385-02-3A. 7247--A 2 1 § 7. Precept for payment of foreign fire insurance premium taxes. Such 2 corporation shall collect and there shall be paid to it all taxes 3 imposed by section [five hundred fifty-three] ninety-one hundred four of 4 the insurance law for fire department use and benefit, upon premiums for 5 insurance against loss or damage by fire covering property situated in 6 the South Salem Fire District, in the town of Lewisboro, county of West- 7 chester, or within any duly organized territory in which the fire 8 district is or may be obligated to render fire protection. The officer 9 of said corporation designated by its by-laws to collect and receive the 10 aforesaid tax shall have all the powers and be subject to all the 11 provisions of the insurance law, relating to treasurers of fire depart- 12 ments. Such corporation shall also be entitled to receive a share of the 13 tax imposed by section [five hundred fifty-four] ninety-one hundred five 14 of the insurance law, based upon the business written in the territory 15 with respect to which it is entitled to collect and receive the tax 16 under section [five hundred fifty-three] ninety-one hundred four of the 17 insurance law. Such taxes shall only be used [for the care and relief of18disabled or indigent volunteer and exempt volunteer firemen and their19families] by the corporation in furtherance of its purpose as set forth 20 in section three of this act. 21 § 2. This act shall take effect immediately; provided, however, that 22 the amendments to section 7 of chapter 538 of the laws of 1975 made by 23 section one of this act shall apply to taxes due on premiums received on 24 and after January 1, 2024.
