SYNOPSIS

     Prohibits public institutions of higher education from establishing scholarship, grant, or loan programs designed to solely benefit students in particular municipality or group of municipalities, except under certain circumstances.

An Act concerning certain financial aid programs established by public institutions of higher education and supplementing chapter 62 of Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  a.  A public institution of higher education shall not establish and administer a scholarship, grant, or loan program that is designed to solely benefit students enrolled at the institution who reside in a particular municipality or group of municipalities.  A scholarship, grant, or loan program established and administered by a public institution of higher education shall be available to all qualified students without regard to their municipality of residence.

     b.    The provisions of subsection a. of this section shall not apply in the case of a scholarship, grant, or loan program that is fully funded by a trust, gift, bequest, or donation, the terms of which are contrary to the  provisions of subsection a. of this section.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would prohibit any public institution of higher education in New Jersey from establishing a scholarship, grant, or loan program that is designed to solely benefit students residing in a particular municipality or group of municipalities.  A scholarship, grant, or loan program established and administered by the institution must be made available to all qualified students without regard to their municipality of residence.  These provisions, however, would not be applicable if the scholarship, grant, or loan program is fully funded by a trust, gift, bequest, or donation, the terms of which require that the scholarship, grant, or loan program be designed to solely benefit students residing in one particular municipality or a group of municipalities.
