AN ACT TO PROVIDE THAT IF ANY OF THE FUNDS APPROPRIATED FOR PURPOSES DUE TO THE COVID-19 PUBLIC HEALTH EMERGENCY HAVE NOT BEEN EXPENDED BY DECEMBER 28, 2020, OR HAVE BEEN DETERMINED TO BE INELIGIBLE TO BE EXPENDED, THEN THE STATE FISCAL OFFICER SHALL TRANSFER THOSE FUNDS INTO THE UNEMPLOYMENT COMPENSATION FUND BY DECEMBER 30, 2020; TO PROVIDE THAT THE PROVISIONS OF THIS ACT SHALL SUPERSEDE ANY CONFLICTING PROVISIONS IN CERTAIN GENERAL BILLS RELATED TO THE COVID-19 PUBLIC HEALTH EMERGENCY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  If any of the funds appropriated from the Budget Contingency Fund under House Bill Numbers 1728, 1749, 1750, 1751, 1752, 1782, 1789, 1795 and 1799 and Senate Bill Numbers 3011, 3012, 3013 and 3014, 2020 Regular Session, have not been expended by December 28, 2020, or if at any time the entity to which those funds were appropriated determines that any of those funds are ineligible to be spent by the entity, then the State Fiscal Officer shall transfer any unexpended funds remaining from those appropriations, or the funds determined to be ineligible, into the Unemployment Compensation Fund not later than December 30, 2020.

     (2)  If any of the funds appropriated from the DFA Cares Act COVID-19 Fund, Mississippi Tourism Recovery Fund, Mississippi Nonprofit Art Museums Recovery Fund, Equity in Distance Learning Fund, Postsecondary Education COVID-19 Mitigation Relief Grant Fund, Independent Schools' COVID-19 Assistance Grant Fund, Mississippi Pandemic Response Broadband Availability Grant Program Fund, Mississippi Emergency Management Agency COVID-19 Fund, Mississippi Electric Cooperatives Broadband COVID-19 Grant Program Fund or COVID-19 Broadband Provider Grant Program Fund under House Bill Numbers 1752, 1790, 1792, 1794, 1797, 1799 and 1800 and Senate Bill Number 3014, 2020 Regular Session, have not been expended by December 28, 2020, or if at any time the entity to which those funds were appropriated determines that any of those funds are ineligible to be spent by the entity, then the State Fiscal Officer shall transfer any unexpended funds remaining from those appropriations, or the funds determined to be ineligible, into the Unemployment Compensation Fund not later than December 30, 2020.

     (3)  The provisions of this section shall supersede the provisions of Section 2 of House Bill No. 1784, Section 8 of Senate Bill No. 3044, Section 3(3) of House Bill No. 1788, Section 3(2) and Section 4(1) of House Bill No. 1791, Sections 5 and 13 of House Bill No. 1793, Section 3 of Senate Bill No. 3046, Section 6(2) of Senate Bill No. 3047, 2020 Regular Session, to the extent of any conflict between those provisions and this section.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
