HOUSE BILL NO. 4663

A bill to amend 1978 PA 368, entitled

"Public health code,"

(MCL 333.1101 to 333.25211) by adding section 16279.

the people of the state of michigan enact:

Sec. 16279. (1) A licensee or registrant who provides an individual with prenatal care, postnatal care, or genetic counseling shall provide the individual with the written information described under subsection (2) at the time the licensee or registrant receives a test result or administers a screening for that individual that indicates a high likelihood for or presence of Down syndrome in a fetus or neonate of that individual.

(2) The department of health and human services shall develop and make available to licensees and registrants who provide individuals with prenatal care, postnatal care, or genetic counseling written information on Down syndrome that meets all of the following requirements:

(a) Is reviewed by medical experts.

(b) Provides all of the following information:

(i) A clinical course description of Down syndrome, including the possible physical, developmental, educational, and psychosocial outcomes.

(ii) The options available for treatment and therapy for conditions related to Down syndrome.

(iii) Projected life expectancies for individuals with Down syndrome.

(iv) Contact information for support services for individuals with Down Syndrome and their caregivers, including information hotlines specific to Down syndrome, resource centers, local and national Down syndrome organizations, and other education, advocacy, and support programs for Down syndrome.

(c) Is culturally and linguistically appropriate for a caregiver of an individual with Down syndrome.

(3) The department of health and human services shall annually update the written information described under subsection (2) and shall make the information available on the department's website.

(4) If a person that provides services described under subsection (2)(b)(iv) requests, the department of health and human services may post the organization's contact information on the department's website with the information described under subsection (3).
