Synopsis: Legislators and state contracts. Provides that a member of
the general assembly who knowingly or intentionally has a pecuniary
interest in, or derives a profit from, a contract or purchase to which the
state is a party commits a Class D felony.

A BILL FOR AN ACT to amend the Indiana Code concerning the
general assembly.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 2-2.1-3-13 IS ADDED TO THE INDIANA CODE
AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2013]: Sec. 13. (a) As used in this section, "member" refers to an
individual who is a member of either:
(1) the house of representatives; or
(2) the senate.
(b) As used in this section, "pecuniary interest" means an interest in a contract or purchase that will result or is intended to result in an ascertainable increase in the income or net worth of:
(1) the member; or
(2) a close relative of the member.
(c) Except as provided in subsection (d), a member who knowingly or intentionally:
(1) has a pecuniary interest in; or
(2) derives a profit from;
a contract or purchase to which the state is a party commits a Class D felony.
(d) Subsection (c) does not apply to a member if any of the following apply:
(1) The member or the member's close relative receives compensation through salary or an employment contract for:
(A) services provided as a member or as a state employee; or
(B) expenses incurred by the member or the member's close relative as provided by law.
(2) The member's or the member's close relative's interest in the contract or purchase and all other contracts and purchases made by the state during the twelve (12) months before the date of the contract or purchase was two hundred fifty dollars ($250) or less.
