Synopsis: Mechanic's liens. Allows an incorporated or unincorporated
association that represents employees, employers, suppliers, or an
employee benefit fund to file a statement and notice of intention to hold
a mechanic's lien on behalf of a person who: (1) is a member of or
participant in the association; (2) performed labor or furnished
materials as described in the mechanic's lien law; and (3) may have a
lien as set forth in mechanic's lien law.
Effective: July 1, 2010.

A BILL FOR AN ACT to amend the Indiana Code concerning
property.
(1) is a member of or participant in the association;
(2) performed labor or furnished materials as described in section 1(a) of this chapter; and
(3) may have a lien as set forth in section 1 of this chapter.
(b) If an incorporated or unincorporated association files a statement and notice of intention to hold a lien under this chapter on behalf of a member of or participant in the association, the association:
(1) has the same rights and remedies under this chapter as the member or participant;
(2) may enforce the lien by filing a complaint on behalf of the
member or participant as provided in this chapter; and
(3) shall identify by name all the members or participants on
whose behalf the association is acting under this chapter in:
(A) the statement and notice of intention to hold a lien;
(B) a complaint filed under this chapter; and
(C) any other document required under this chapter to
have or enforce a lien.
