Bill Title: Amends the Liquor Control Act of 1934. Creates a winery special use license. Provides that a winery special use license shall allow an Illinois first-class or second-class wine-maker or a first class or second class wine-manufacturer to transfer some of its wine inventory from its licensed premises to the premises specified in the local liquor authority license for sale at retail only at premises specified in the local authority license and only for the dates and times specified. Provides that a winery special use license shall be granted for a period not to exceed 12 months and may be renewed annually, provided that the applicant submits proof satisfactory to the State Commission that the applicant will provide dram shop liability insurance to the maximum limits and will obtain local authority approval. Provides that a winery special use licensee shall only sell its own manufactured wine.

11 | granted for a period not to exceed 12 months for a maximum of | ||||||
12 | 15 consecutive days or 50 non-consecutive days at a single | ||||||
13 | location. An applicant for a winery special use permit must | ||||||
14 | also submit with the application to the State Commission a list | ||||||
15 | of dates and locations of all events to be scheduled during the | ||||||
16 | 12-month license period and proof satisfactory to the State | ||||||
17 | Commission that the applicant will provide dram shop liability | ||||||
18 | insurance to the maximum limits. If the date and location of an | ||||||
19 | event is undetermined at the time of application, then the | ||||||
20 | winery special use permit holder shall submit to the State | ||||||
21 | Commission the date and time of the additional event in a | ||||||
22 | manner acceptable to the State Commission at least 7 days prior | ||||||
23 | to the event, at which time the permit holder shall obtain an | ||||||
24 | amended winery special use permit. The winery special use | ||||||
25 | permit holder shall obtain local authority approval for each | ||||||
26 | use of the permit and the winery special use permit shall state |

1 | "THIS WINERY SPECIAL USE PERMIT SHALL BE VOID IF THE NAMED | ||||||
2 | HOLDER IS UNABLE TO OBTAIN AND PRODUCE ADEQUATE WRITTEN PROOF | ||||||
3 | THAT WINE SALES BY THE PERMIT HOLDER HAVE BEEN AUTHORIZED BY | ||||||
4 | THE LOCAL LIQUOR LICENSING AUTHORITY.". The State Commission | ||||||
5 | may issue a winery special use permit prior to local authority | ||||||
6 | approval. State Commission approval of the winery special | ||||||
7 | permit does not mandate local approval of wine sales at the | ||||||
8 | event. A winery special use permit shall allow the applicant to | ||||||
9 | sell only its own manufactured wine. "; and
