Bill Title: Proposes to amend the Revenue Article of the Illinois Constitution. Adds a new Section concerning highway funds. Provides that no moneys derived from taxes, fees, excises, or license taxes, relating to registration, titles, operation, or use of vehicles or public highways, roads, streets, bridges, mass transit, intercity passenger rail, ports, or airports, or motor fuels, including bond proceeds, shall be expended for other than costs of administering laws related to vehicles and transportation, costs for construction, reconstruction, maintenance, repair, and betterment of public highways, roads, streets, bridges, mass transit, intercity passenger rail, ports, airports, or other forms of transportation, and other statutory highway purposes, including the State or local share to match federal aid highway funds. Limits the costs of administering laws related to vehicles and transportation to direct program expenses of the Secretary of State, the State Police, and the Department of Transportation related to the enforcement of traffic laws and safety. Provides that the revenues described herein shall not be diverted to any other purpose. Provides that any additional modes of transportation proposed for State funding shall have dedicated sources of funding. Provides that federal funds may be spent for any purposes authorized by federal law. Effective upon being declared adopted in accordance with Section 7 of the Illinois Constitutional Amendment Act.

13 | SECTION 11. HIGHWAY FUNDS | |||||||||||||||||||
14 | (a) No moneys derived from taxes, fees, excises, or license | |||||||||||||||||||
15 | taxes relating to registration, titles, operation, or use of | |||||||||||||||||||
16 | vehicles or public highways, roads, streets, bridges, mass | |||||||||||||||||||
17 | transit, intercity passenger rail, ports, or airports, or to | |||||||||||||||||||
18 | fuels used for propelling vehicles, including bond proceeds, | |||||||||||||||||||
19 | and from taxes, fees, excises, or license taxes relating to any | |||||||||||||||||||
20 | other transportation infrastructure or transportation | |||||||||||||||||||
21 | operation shall be expended for other than costs of | |||||||||||||||||||
22 | administering laws related to vehicles and transportation, | |||||||||||||||||||
23 | statutory refunds and adjustments provided in those laws, |

1 | payment of highway obligations, costs for construction, | ||||||
2 | reconstruction, maintenance, repair, and betterment of public | ||||||
3 | highways, roads, streets, bridges, mass transit, intercity | ||||||
4 | passenger rail, ports, airports, or other forms of | ||||||
5 | transportation, and other statutory highway purposes, the | ||||||
6 | State or local share to match federal aid highway funds, | ||||||
7 | expenses of grade separation of public highways and railroad | ||||||
8 | crossings, protection of at-grade public highways and railroad | ||||||
9 | crossings, and, with respect to local governments, other | ||||||
10 | transportation purposes as authorized by law. Costs of | ||||||
11 | administering laws related to vehicles and transportation | ||||||
12 | shall be limited to direct program expenses of the Secretary of | ||||||
13 | State, the Department of State Police, and the Department of | ||||||
14 | Transportation, or their successor agencies, related to the | ||||||
15 | enforcement of traffic laws or the safety of public highways, | ||||||
16 | roads, streets, bridges, mass transit, intercity passenger | ||||||
17 | rail, ports, or airports. | ||||||
18 | (b) None of the revenues described in subsection (a) of | ||||||
19 | this Section shall, by transfer, offset, or otherwise, be | ||||||
20 | diverted to any purpose other than those described in | ||||||
21 | subsection (a) of this Section. | ||||||
22 | (c) If a mode of transportation not described in subsection | ||||||
23 | (a) is first proposed for State funding after this Section is | ||||||
24 | added to the Constitution, the mode of transportation must have | ||||||
25 | a dedicated source of funding. | ||||||
26 | (d) Federal funds may be spent for any purposes authorized |

3 | This Constitutional Amendment takes effect upon being | ||||||
4 | declared adopted in accordance with Section 7 of the Illinois | ||||||
