Bill Title: Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Provides that the Department of Commerce and Economic Opportunity shall compile and publish a disparity study by December 31, 2027 (rather than December 31, 2022) that: (1) evaluates demographic data (rather than whether there exists intentional discrimination) at the supplier or distribution level for retailers of beauty products, cosmetics, hair care supplies, and personal care products in the State of Illinois; and (2) includes recommendations for reducing or eliminating any barriers to entry for underrepresented populations (rather than to those) wishing to establish businesses at the retail level involving such products. Removes language requiring the study to evaluate the impact of the discrimination evaluated under paragraph (1) on the State. Extends the repeal of the provisions to January 1, 2029 (rather than January 1, 2024). Effective immediately.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Department of Commerce and Economic | |||||||||||||||||||
5 | Opportunity Law of the Civil Administrative Code of Illinois | |||||||||||||||||||
6 | is amended by changing Section 605-1080 as follows:

9 | Sec. 605-1080. Personal care products industry supplier | |||||||||||||||||||

11 | (a) The Department shall compile and publish a disparity | |||||||||||||||||||
12 | study by December 31, 2027 2022 that: (1) evaluates | |||||||||||||||||||
13 | demographic data whether there exists intentional | |||||||||||||||||||
14 | discrimination at the supplier or distribution level for | |||||||||||||||||||
15 | retailers of beauty products, cosmetics, hair care supplies, | |||||||||||||||||||
16 | and personal care products in the State of Illinois; and (2) if | |||||||||||||||||||
17 | so, evaluates the impact of such discrimination on the State | |||||||||||||||||||
18 | and includes recommendations for reducing or eliminating any | |||||||||||||||||||
19 | barriers to entry for underrepresented populations to those | |||||||||||||||||||
20 | wishing to establish businesses at the retail level involving | |||||||||||||||||||
21 | such products. The Department shall forward a copy of its | |||||||||||||||||||
22 | findings and recommendations to the General Assembly and | |||||||||||||||||||
23 | Governor. |

1 | (b) The Department may compile, collect, or otherwise | ||||||
2 | gather data necessary for the administration of this Section | ||||||
3 | and to carry out the Department's duty relating to the | ||||||
4 | recommendation of policy changes. The Department shall compile | ||||||
5 | all of the data into a single report, submit the report to the | ||||||
6 | Governor and the General Assembly, and publish the report on | ||||||
7 | its website. | ||||||
8 | (c) This Section is repealed on January 1, 2029 2026 . | ||||||
