Bill Title: Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that disenrollment of a Medicaid enrollee from a managed care organization under contract with the Department of Healthcare and Family Services shall be in accordance with specified federal requirements whenever a contract is terminated between a Medicaid managed care health plan and a primary care provider that results in a disruption to the Medicaid enrollee's provider-beneficiary relationship. Effective immediately.

1 | AN ACT concerning public aid.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Illinois Public Aid Code is amended by | ||||||
5 | adding Section 5-30.6 as follows:
| ||||||
6 | (305 ILCS 5/5-30.6 new) | ||||||
7 | Sec. 5-30.6. Disenrollment requirements; managed care | ||||||
8 | organization. Disenrollment of a Medicaid enrollee from a | ||||||
9 | managed care organization under contract with the Department | ||||||
10 | shall be in accordance with the requirements of 42 CFR 438.56 | ||||||
11 | in effect on January 1, 2018. Whenever a contract is terminated | ||||||
12 | between a Medicaid managed care entity and a primary care | ||||||
13 | provider that results in a disruption to the enrollee's | ||||||
14 | provider-patient relationship, the Department shall approve | ||||||
15 | any request from the enrollee for disenrollment from the plan.

16 | Section 99. Effective date. This Act takes effect upon | ||||||
17 | becoming law.
