A BILL FOR AN ACT

 

 

Relating to children.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  The department of human services shall establish a three-year pilot project to develop and operate statewide emergency care, hanai ohana care, and specialized learning facilities for endangered and disadvantaged children.  For the purposes of this Act and pursuant to Senate Concurrent Resolution No. 189 (2004), the department shall cooperate with Malama O Kamalii Makamae, a nonprofit organization devoted to assisting needy children.  In particular, the pilot project shall focus on assisting native Hawaiian children younger than thirteen years of age who are homeless or from low-income households, pursuant to House Concurrent Resolution No. 189 (2007), and newborns abandoned in the State, pursuant to Act 7, Special Session Laws of Hawaii 2007.

     (b)  The pilot project shall assist children whose physical, emotional, mental, social, or educational well‑being is in imminent danger.  This assistance shall come in the form of offering safe havens for children in crisis, supplying health care and proper nutrition, and providing social and educational services.  Specifically, the pilot project shall:

     (1)  Offer medical examinations upon a child's arrival at a safe haven or emergency facility;

     (2)  Schedule educational activities at safe havens or emergency facilities; and

     (3)  Provide pilot project staff and Malama O Kamalii Makamae employees with training to address the special needs of the children.  The department of human services may consult with the department of health, the department of education, or any other appropriate agencies to develop and facilitate staff and employee training.

     (c)  In addition to subsection (b), the pilot project may provide services or develop programs that provide assistance to homeless, low-income, and native Hawaiian children, as the pilot project coordinators deem appropriate.

     SECTION 2.  Notwithstanding any law to the contrary, including chapter 171, Hawaii Revised Statutes, the department of land and natural resources shall provide reduced lease rent rates to the department of human services for parcels in suitable locations to establish the pilot program consistent with this Act.

     SECTION 3.  This Act shall take effect on July 1, 2009, and shall be repealed on July 1, 2012.
