A BILL FOR AN ACT

 

 

RELATING TO TRANSPORTATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  This Act is recommended by the governor for immediate passage in accordance with section 9 of article VII of the Constitution of the State of Hawaii.

     SECTION 2.  The legislature finds that the current Daniel K. Inouye International Airport (Honolulu airport) airport layout plan indicates that there are issues related to the airspace regulations established by the Federal Aviation Administration under title 14 Codes of Federal Regulations part 77.  In addition, all airline operators must consider an emergency flight plan known as a one-engine inoperative (OEI) scenario, and for most airlines using runway 8L at Honolulu airport, the closest runway to the airport terminal, this OEI departure path is located directly over the existing gantry cranes at Honolulu harbor’s Sand Island terminal, which have been identified as an obstruction in the navigable airspace above Honolulu airport.

     The modernization of Honolulu harbor, the port-of-entry for cargo into the State, further interferes with the navigable airspace around the Honolulu airport.  The existing gantry cranes at Sand Island will be replaced with taller and wider cranes to accommodate larger container ships that are scheduled to arrive in 2018.  The department of transportation, harbors division, is also currently undertaking another modernization project for Kapalama container terminal.  This modernization project includes provisions for the installation of additional gantry cranes to accommodate larger and more efficient container ships at Honolulu harbor, which are expected to arrive at the estimated completion of this project in 2022.  These taller gantry cranes at Honolulu harbor will exacerbate the obstruction concerns related to the OEI path over Sand Island.

     With the support of the Airlines Committee of Hawaii, an alternate OEI route north of the Sand Island and Kapalama container terminals at Honolulu harbor has been proposed.  However, the existing "I Heart Radio" aerial located near Dillingham boulevard and Kokea street obstructs the proposed alternate OEI route.  Thus, the aerial needs to be relocated to allow for this alternate route around the taller cranes.

     This emergency appropriation is needed immediately to ensure the timely relocation of the tower prior to the arrival and installation of the taller and wider cranes at Honolulu harbor, which are expected to arrive in November or December 2018.

     The purpose of this Act is to make an emergency appropriation for the relocation of the transmission facilities for the "I Heart Radio" aerial.  The legislature finds and declares that this appropriation is in the public interest and for the public's health, safety, and general welfare of the State.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $3,000,000 or so much thereof as may be necessary for fiscal year 2017-2018 for the planning, land acquisition, design, construction, and equipment for the relocation, in part, of the "I Heart Radio" aerial located near the Kapalama canal on Dillingham boulevard to an appropriate location; provided that such relocation may be done in phases.

     The sum appropriated shall be expended by the department of transportation for the purposes of this Act.

     SECTION 4.  This Act shall take effect upon its approval.
