A BILL FOR AN ACT

 

 

relating to ZERO EMISSION VEHICLES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that due to the growing threats of human-induced climate change and a rising cost of living, the State has committed to one hundred per cent clean energy and a carbon-negative economy by 2045.  Progress towards this goal has already resulted in cheaper renewable energy in the islands over the last decade and reduced electricity rates for local residents.  The State and all counties have also committed to one hundred per cent clean ground transportation and are on track to convert all public vehicle fleets to zero-emissions vehicles by 2035.

     The legislature further finds that next to public vehicle fleets, rental motor vehicles represent the largest passenger vehicle fleets in Hawaii and are responsible for a significant amount of carbon emissions.  Transitioning rental motor vehicle fleets to zero-emission vehicles would significantly reduce carbon emissions.  It would also increase the number of zero-emissions vehicles entering the secondary market, making clean electric vehicles more affordable to local residents and thereby reducing their costs of transportation.  Finally, it would demonstrate to all visitors to the State that Hawaii can keep pace with the innovation and electrification of transportation already underway in cities across Asia, remain competitive in clean transportation, and reaffirm Hawaii's status as a sustainable destination.

     The purpose of this Act is to assist with the transition to clean zero-emissions rental motor vehicle fleets.

     SECTION 2.  Chapter 437D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§437D-    Zero-emission vehicles.  (a)  All lessors of rental motor vehicles in the State shall incorporate zero-emissions vehicles into their rental motor vehicle fleets according to the following schedule:

     (1)  At least ten per cent by January 1, 2025;

     (2)  At least thirty per cent by January 1, 2030; and

     (3)  One hundred per cent by January 1, 2035.

     (b)  For the purposes of this section:

     "Rental motor vehicle" shall have the same meaning as in section 251-1.

     "Zero-emission vehicle" means:

     (1)  An electric vehicle as defined in section 291-71;

     (2)  A hydrogen fuel cell vehicle with four or more wheels that draws propulsion from electricity generated by passing hydrogen through a fuel cell; and

     (3)  A plug-in hybrid electric vehicle with four or more wheels that draws propulsion from a battery and has an internal combustion engine that may be used to either propel the vehicle directly or to produce electricity to recharge the battery."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
