A BILL FOR AN ACT

 

 

making an appropriation for kihei high school.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Maui county has exhibited relatively strong growth over the past two decades.  According to the 2010 United States Census Bureau, the resident population of Maui county increased by over twenty per cent between 2000 and 2010.  The resident population of the Kihei-Makena region in South Maui in particular experienced significant growth, increasing by forty-nine per cent between 1990 and 2000, with a projected increase of twenty-eight per cent from the 2010 population by 2025.

     The legislature also finds that south Maui currently lacks a high school.  Significant population growth in the Kihei-Makena region, along with geographical separation from existing central Maui high schools, has created a need for a new high school in south Maui.  Students in Kihei must travel long distances to attend high school in central Maui.  Furthermore, the lack of a high school in the south Maui area has raised enrollment at two central Maui schools, Maui high school and Baldwin high school.  In 2011, Maui high school exceeded its design capacity by over two hundred students, and Baldwin high school was within fifty students of its design capacity.

     The legislature additionally finds that the department of education has been planning to build a high school in south Maui for several years and is currently seeking ways to obtain the financing necessary to continue the project and construct the school within the next several years.

     The legislature has previously appropriated over $32,000,000 toward the planned Kihei high school; however, almost $20,000,000 of the funds appropriated have lapsed.

     Act 41, Session Laws of Hawaii 2004, appropriated $5,500,000 in special funds and general obligation bond revenue for plans and design for a new public high school in Kihei, Maui; ground and site improvements; and equipment and appurtenances.  According to the department of budget and finance, $700,000 of the $5,500,000 was released for planning, but the remaining amount lapsed on June 30, 2006.

     Act 160, Session Laws of Hawaii 2006, appropriated $7,300,000 in special funds and general obligation bond revenue for plans, land acquisition, and design for a new high school in Kihei, Maui; ground and site improvements; and equipment and appurtenances.  According to the department of budget and finance, $2,735,000 was released for land acquisition, and $4,565,000 was released for design.

     Act 158, Session Laws of Hawaii 2008, appropriated $20,000,000 in special funds and general obligation bond revenue for plans, land acquisition, design, construction, and equipment for a new high school in Kihei, Maui; ground and site improvements; and equipment and appurtenances.  According to the department of budget and finance, $5,265,000 of the $20,000,000 was released for land acquisition, and the remaining amount lapsed on June 30, 2010.

     The legislature finds that land for the new school has already been secured and money for payment has been encumbered.  However, an appropriation of funds for Kihei high school that have previously lapsed is necessary at this time so that the remaining planning, design, and construction work on this project may resume without further delay.

     Accordingly, the purpose of this Act is to authorize the issuance of general obligation bonds for the planning, design, and construction of the new high school in Kihei, Maui.

     SECTION 2.  The director of finance is authorized to issue general obligation bonds in the sum of $20,000,000 or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2012-2013 for Kihei high school in Kihei, Maui, as follows:

          Planning                      $700,000

          Design                      $1,000,000

          Construction               $18,300,000

     Total funding                         $20,000,000

     The sum appropriated shall be expended by the department of education for the purposes of this Act.

     SECTION 3.  The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2014, shall lapse as of that date.

     SECTION 4.  This Act shall take effect on July 1, 2012.
