A BILL FOR AN ACT

 

 

relating to cargo inspections.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that, each year, over one hundred thousand containers are shipped into the State from the continental United States.  Only a small fraction of these containers, however, are inspected by government officials or agencies.  Matson and Horizon shipping companies have reported that only about five per cent of their shipping containers are inspected, which means items such as aerial fireworks, crystal methamphetamine, guns, and other contraband have a greater likelihood of being smuggled into the State.

     All containers from foreign ports, on the other hand, are inspected by government agencies and all domestic agriculture cargo from the mainland is also inspected for invasive species.

     The purpose of this Act is to develop a plan to increase the random inspection rate of domestic cargo from five per cent to ten per cent by January 1, 2013, and to twenty-five per cent by January 1, 2015.

     SECTION 2.  (a)  The state departments of defense and transportation shall meet with federal, state, and private agencies and organizations involved with shipping cargo into the State, to develop a plan to increase the random inspection rates of incoming domestic cargo in order to detect and remove illegal contraband smuggled into the State.

     (b)  The plan shall include:

     (1)  A time frame to increase the random cargo inspection rate from five per cent to ten per cent by January 1, 2013, and to twenty-five per cent by January 1, 2015; and

     (2)  Estimated costs of the resources needed to implement the plan, such as personnel, contraband inspection dogs, high technology equipment, and other necessary resources to fulfill the purposes of this Act.

     (c)  The state department of transportation shall act as the lead agency with respect to submitting a report to the legislature, including its findings, recommendations, and any suggested legislation, no later than twenty days prior to the convening of the 2011 regular session of the legislature.

     SECTION 3.  This Act shall take effect upon its approval.
