A BILL FOR AN ACT

 

 

relating to public safety.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Act 189, Session Laws of Hawaii 2011, established the reduced ignition propensity cigarette program special fund, with moneys in the special fund to be expended by the state fire council for administration of the reduced ignition propensity cigarette program, including employing one full-time administrator and one full-time assistant.  The revenue sources for the special fund are the fees collected by the state fire council under the program as provided for in section 132C-4, Hawaii Revised Statutes, and interest accrued.  Since the reduced ignition propensity cigarette program's implementation on September 30, 2009, approximately $444,000 has been collected.

     The purpose of this Act is to amend the reduced ignition propensity cigarette program special fund to allow for appropriations by the legislature, and to appropriate $400,000 from the general fund to the special fund to implement the program and hire necessary staff.

     SECTION 2.  Section 132C-9, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  There is established in the state treasury a reduced ignition propensity cigarette program special fund, into which shall be deposited all moneys [collected]:

     (1)  Appropriated to the fund by the legislature; and

     (2)  Collected by the state fire council from the reduced ignition propensity cigarette program pursuant to section 132C-4.

All interest earned or accrued on moneys deposited in the fund shall become part of the fund."

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $400,000 or so much thereof as may be necessary for fiscal year 2012-2013 to be deposited into the reduced ignition propensity cigarette program special fund.

     SECTION 4.  There is appropriated out of the reduced ignition propensity cigarette program special fund the sum of $400,000 or so much thereof as may be necessary for fiscal year 2012-2013 for the cost of activities and requirements of section 132C-4, Hawaii Revised Statutes, including employing one full-time administrator and one full-time assistant.

     The sum appropriated shall be expended by the state fire council for the purposes of this Act.

     SECTION 5.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 6.  This Act shall take effect on July 1, 2012.
