A BILL FOR AN ACT

 

 

relating to fresh hawaii agricultural products.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 103D, Hawaii Revised Statutes, is amended by adding a new section to part X to be appropriately designated and to read as follows:

     "§103D-    Fresh Hawaii agricultural products.  (a)  Notwithstanding any other provision of law, publicly funded hospitals, public schools, and state correctional facilities shall purchase fresh Hawaii agricultural products when available.

     (b)  The chief procurement officer shall compile and maintain a list of fresh Hawaii agricultural products that includes the names of producers and distributors who offer for sale fresh Hawaii agricultural products and a description of the products.  Copies of the list shall be distributed to all publicly funded hospitals, public schools, state correctional facilities, and any other purchasing agencies that request the list.

     (c)  This section shall not apply whenever its application will disqualify any governmental agency subject to this section from receiving federal funds or aid.

     (d)  For purposes of this section:

     "Fresh Hawaii agricultural product" means agricultural products that are grown or raised in the State, including but not limited to fruits, vegetables, livestock, seafood, and flowers, that are unprocessed except for minimal processing that may be required to prepare or purchase the agricultural products for sale.

     "Minimal processing" includes slaughtering and cutting, but does not include canning, preserving, freezing, pickling, or drying, with or without added ingredients."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2009.
