A BILL FOR AN ACT
relating to contractors.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 444-10.7, Hawaii Revised Statutes, is amended to read as follows:
"[[]§444-10.7[]]
Enhanced penalties when elderly persons are targeted. If any person is
found to have violated section 444-9 and the violation is committed against
elderly persons, in addition to any other penalty set forth or imposed, the
court may impose a fine of up to [$10,000,] $20,000, or
imprisonment up to one year, or both. As used in this section, "elderly
person" means a person who is sixty-five years of age or older."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
