A BILL FOR AN ACT

 

 

relating to THE JOINT TERRORISM TASK FORCE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1.  The legislature finds that the world is under terroristic attack, and the State must be vigilant to protect its islands and residents.  As one of the largest military outposts in the nation and the critical site of United States military presence in the pacific, Hawaii may be a target of terroristic threats or attacks.  In the wake of international terrorism, Hawaii must ensure preparedness and proper procedures should a terroristic threat or attack take place.

The legislature further finds that it is the duty of our federal and State governmental departments to prepare the proper procedures for such potential terroristic threats or attack and develop a counterterrorism plan that addresses the security issues and necessary response.  Ultimately, a partnership between the various federal and State law enforcement agencies to development this plan is in the State's best interest.

The purpose of this bill is to establish in the office of the governor a joint terrorism task force of various State and federal law enforcement agencies to fight terrorism.

SECTION 2.  (a)  There is established in the office of the governor a joint terrorism task force of various State and federal government law enforcement agencies to fight terrorism.  The federal agencies are invited to participate on a voluntary basis.

(b)  The task force shall develop an emergency counterterrorism plan for the State that addresses certain security issues resulting from a terroristic attack or terroristic threat to the State and any necessary response.

(c)  The adjutant general of the department of defense shall serve as chairperson of the task force.

(d)  In addition to the adjutant general of the department of defense, the task force shall consist of the following members or their representatives:

(1)  The secretary of the United States Department of Homeland Security, who is invited to participate on a voluntary basis;

(2)  The administrator of the United States Transportation Security Administration, who is invited to participate on a voluntary basis;

(3)  The inspector general of the United States Pacific Command, who is invited to participate on a voluntary basis;

(4)  The chief of police of the Honolulu police department;

     (5)  The chief of police of the Hawaii police department;

     (6)  The chief of police of the Kauai police department;

     (7)  The chief of police of the Maui police department; and

     (8)  The director of the department of public safety.

     (e)  The task force shall:

     (1)  Identify potential terroristic threats to the State;

     (2)  Identify weaknesses in the State's geography, economy, and social structure that creates vulnerabilities to terrorism in the State;

     (3)  Develop a communications process to alert the public of terroristic threats and terroristic attacks in the State; and

     (4)  Develop a response plan for possible terroristic threats.

     (f)  The task force shall submit reports of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2017.

     (g)  The task force shall cease to exist on June 30, 2017.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2016-2017 for costs incurred by the joint terrorism task force pursuant to this Act.

     The sum appropriated shall be expended by the office of the governor for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2016.
