A BILL FOR AN ACT
RELATING TO SCHOOL FACILITIES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. (a) The department of education shall conduct a review of all school consolidation studies completed by the department within the ten years immediately preceding the effective date of this Act. In conducting this review, the department of education shall evaluate whether the findings and recommendations of the consolidation studies remain valid, using the criteria for consolidation studies set forth in section 8‑38-4(b), Hawaii Administrative Rules.
(b) The department of education shall also consider the feasibility of repurposing any school facility covered by a consolidation study as a sanctuary or safe haven for vulnerable populations, including but not limited to:
(1) Elderly persons;
(2) Persons under eighteen years of age; or
(3) Single parents with children.
(c) In conducting the feasibility analysis required by subsection (b), the department of education shall take into account the minimum requirements provided in section 346‑374.5(b), Hawaii Revised Statutes.
(d) Upon the request of the department of education, the department of human services shall assist the department of education in the completion of the feasibility analysis required by subsections (b) and (c).
(e) For the purpose of this section, "consolidation study" means any study or report conducted by the department of education or board of education pursuant to chapter 38 of title 8, Hawaii Administrative Rules, initiated to determine whether:
(1) An existing school should be closed; and
(2) The existing school's students should be transferred to another school.
SECTION 2. The department of education shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2019.
SECTION 3. This Act shall take effect on January 1, 2050.
