A BILL FOR AN ACT

 

 

relating to farmers markets.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 486, Hawaii Revised Statutes, is amended by adding a new section to part V to be appropriately designated and to read as follows:

     "§486-     Non-Hawaii-made products; farmers markets.  No person shall keep, offer, display or expose for sale, or solicit for the sale of any item, product, souvenir, or any other merchandise at a farmers' market that has not been manufactured, assembled, fabricated, cultivated, or produced within the State and has not had at least fifty-one per cent of its wholesale value added by manufacture, assembly, fabrication, cultivation, or production within the State unless the item, product, souvenir, or merchandise is labelled "made out-of-state" or that by any other means represents the origin of the item, product, souvenir, or merchandise as being from a place outside the State.

     For the purposes of this section, "farmers' market" means an outdoor market composed of independent business operators who sell goods or services to the public."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
