A BILL FOR AN ACT

 

 

RELATING TO DIGITAL IDENTIFICATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  The director of transportation shall establish and implement a digital identification pilot program for the issuance of digital identification; provided that each examiner of drivers shall administer the pilot program in the examiner of drivers' respective county; provided further that the office of enterprise technology services shall assist the director of transportation in establishing and implementing the pilot program.

     (b)  In establishing the digital identification pilot program, the director of transportation shall:

     (1)  Assess existing infrastructure that may be used for digital identification implementation and identify any infrastructural changes necessary to implement the pilot program;

     (2)  Upgrade the existing infrastructure based on the director's findings pursuant to paragraph (1);

     (3)  Acquire or, if necessary, develop a mobile application for existing infrastructure that shall include the following functions:

          (A)  Enroll users by validating a government-issued form of identification;

          (B)  Display digital identification that includes all information required under chapter 286, Hawaii Revised Statutes;

          (C)  An authentication and verification process for a wireless communication device; and

          (D)  Ability to be used in any location regardless of the location's level of wireless connectivity or cellular telephone service;

     (4)  Deploy the digital identification mobile application at no cost to focus groups for testing and evaluation;

     (5)  In coordination with the department of the attorney general and the applicable county government, as necessary, implement a law enforcement version of the application for field testing the acceptance of digital identification as proof of identity in law enforcement settings;

     (6)  In coordination with the department of business, economic development, and tourism and the Hawaii tourism authority, assess opportunities for the use of digital identification to improve government support to business operations, economic development, and tourism and include in the report submitted pursuant to subsection (e) any findings and recommendations from the pilot program to promote these opportunities;

     (7)  In coordination with the department of human services, assess opportunities for the use of digital identification to improve department of human services operations and include in the report submitted pursuant to subsection (e) findings and recommendations from the pilot program to promote these opportunities; and

     (8)  Ensure that automatic voter registration is included in the pilot program.

     (c)  The director of transportation may contract with a third party to establish the pilot program.

     (d)  In coordination with the department of the attorney general; department of business, economic development, and tourism; department of human services; Hawaii tourism authority; and county governments, as applicable, the director of transportation shall submit a report of the director's findings and recommendations regarding digital identification implementation, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2023.

     (e)  For the purposes of this section, "digital identification" includes a driver's license and government-issued identification card issued in a digital format.

     SECTION 2.  This Act shall take effect on July 1, 2050, and shall be repealed on June 30, 2025.
