A BILL FOR AN ACT

 

 

relating to planning.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  In order to grow and prosper as a state, it is important to take deliberate measures in charting and planning the course of growth and investment in state resources.  This process must include an ongoing dialogue among the many stakeholders in Hawaii's future to ensure that the best decisions are made in the best interests of the people of Hawaii.

     The purpose of this Act is to establish a temporary task force to begin a dialogue leading toward the updating of the Hawaii state planning act and to provide for a review of the current budget planning process.

     SECTION 2.  (a)  There is established within the governor's office for administrative purposes a temporary task force to review and update the Hawaii State Planning Act and the planning, programming, and budgeting system of the State.  The governor shall convene the task force within thirty days after the effective date of this Act.

     (b)  As part of its review of the planning, programming, and budgeting system of the State, the task force shall:

     (1)  Conduct a comprehensive review of chapter 226, Hawaii Revised Statutes, and develop recommendations on all aspects of public policy already identified under chapter 226, Hawaii Revised Statutes, and whether any provisions of the Hawaii State Planning Act relating to the direction and focus of the State for the next fifty years should be retained, amended, or repealed;

     (2)  In addition to the review prescribed in paragraph (1), consider other public policy areas that need to be addressed by the State for the next fifty years and make recommendations on those areas;

     (3)  Provide a strategy that includes a mechanism by which the public may be involved in finalizing any update of the Hawaii State Planning Act;

     (4)  Consider how the system is currently employed by state agencies and departments in establishing their respective budgets;

     (5)  Examine computer platforms, work processes, financial reporting capabilities, data analysis capabilities of the executive branch, and the budget deliberation requirements of the legislative branch; and

     (6)  Provide a strategy for updating the information systems used by the state agencies and departments to make the process more efficient and expedient and more contemporary to what is commonly used by other state governments and similar-sized private organizations.

     (c)  The task force shall be composed of:

     (1)  The chairperson of the senate ways and means committee or the chairperson's designee;

     (2)  The chairperson of the house finance committee or the chairperson's designee;

     (3)  The chairperson of the senate water, land, and housing committee or the chairperson's designee;

     (4)  The chairperson of the house water, land, and ocean resources committee or the chairperson's designee;

     (5)  The chairperson of the senate economic development and technology committee or the chairperson's designee;

     (6)  The chairperson of the house economic revitalization and business committee or the chairperson's designee;

     (7)  A senator appointed by the president of the senate;

     (8)  A representative appointed by the speaker of the house of representatives;

     (9)  The director of budget and finance or the director's designee;

    (10)  The comptroller or the comptroller's designee;

    (11)  The director of the office of planning or the director's designee;

    (12)  The chairperson of the board of directors of the Chamber of Commerce of Hawaii or the chairperson's designee;

    (13)  The executive director of the economic research organization at the University of Hawaii (UHERO) or the executive director's designee;

    (14)  The chairperson of the board of directors of the Hawaii tourism authority or the chairperson's designee; and

    (15)  The president of the Tax Foundation of Hawaii or the president's designee.

     (d)  The members of the task force shall:

     (1)  Select the chairperson of the task force from among its members; and

     (2)  Serve without compensation, but may be reimbursed for necessary expenses, including travel expenses, incurred in the performance of their official duties under this Act.

     (e)  The chairperson of the task force may select additional task force members at the chairperson's discretion.

     (f)  The office of planning shall provide all administrative, technical, professional, and clerical support required by the task force for matters pertaining to the review and update of the Hawaii State Planning Act.

     The department of budget and finance shall provide all administrative, technical, professional, and clerical support required by the task force for matters pertaining to the review and update of the planning, programming, and budgeting system.

     (g)  In developing its preliminary recommendations, the task force may conduct meetings without regard to chapter 92, Hawaii Revised Statutes.

     By no later than December 15, 2011, the task force shall adopt its final recommendations, prepare an interim report, and draft any proposed legislation for submission to the legislature for its consideration in the 2012 regular session.

     (h)  If the task force's recommendations on starting the process to implement an update of the Hawaii State Planning Act and the State's planning, programming, and budgeting system are approved by the legislature, on or after July 1, 2012, but in no case later than twenty days after that date, the task force shall reconvene to review the actions taken by the twenty-sixth legislature of the State of Hawaii 2012 regarding:

     (1)  The task force's recommendations and legislation submitted pursuant to this Act; and

     (2)  Any other amendments made to chapter 226, Hawaii Revised Statutes, or chapters of the Hawaii Revised Statutes relating to the State's planning, programming, and budgeting system.

Based on the actions of the legislature and any existing task force recommendations that were not acted upon by the legislature, amended recommendations, or new recommendations, the task force shall begin conducting public hearings on its recommendations regarding the updating of the Hawaii State Planning Act and the implementation of the State's planning, programming, and budgeting system.

     (i)  At a minimum, the task force shall conduct a public hearing on the island of Oahu to solicit public comments on the updates to the Hawaii State Planning Act to be implemented; provided that:

     (1)  The public hearing shall be subject to the open meeting and public notice requirements of chapter 92, Hawaii Revised Statutes; and

     (2)  The task force shall provide public notice not less than seventy-two hours prior to the hearing, in accordance with section 1-28.5, Hawaii Revised Statutes; provided that notwithstanding any other provisions of chapter 92 or section 1-28.5, Hawaii Revised Statutes, the minimum time period for posting a public hearing notice shall be not less than seventy-two hours prior to the public hearing being noticed.

The task force may include a summary of comments received during the public hearing in its reports to the legislature pursuant to subsection (j).

     (j)  The task force shall annually submit a report of its findings and recommendations, including proposed legislation, to the legislature no later than twenty days prior to the convening of each regular session, beginning with the 2012 regular session and until the 2015 regular session.

     (k)  The task force shall cease to exist on June 30, 2015.

     SECTION 3.  This Act shall take effect on July 1, 2112.
