Blanks out the sunset date of Act 2, Second Special Session Laws of Hawaii 2007; clarifies Act 2 to prohibit operation of large capacity ferry vessel if no environmental impact statement is accepted prior to sunset of Act 2; terminates authority to operate large capacity ferry vessel unless agreement between DOT and operator reached on financing debt service and principal of general obligation bonds by 45 days after adjournment sine die of       regular session.  (HB1171 HD1)

A BILL FOR AN ACT

 

 

RELATING TO TRANSPORTATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Act 2, Second Special Session Laws of Hawaii 2007, is amended by adding a new section to part III to be appropriately designated and to read as follows:

     "SECTION   .  All authority to operate a large capacity ferry vessel granted pursuant to section 3 of this Act shall cease if an environmental impact statement is not accepted by the office prior to the repeal of this Act."

     SECTION 2.  Act 2, Second Special Session Laws of Hawaii 2007, is amended by amending section 18 to read as follows:

     "SECTION 18.  This Act shall take effect upon its approval; provided that this Act shall be repealed on the earlier of:

     (1)  The forty-fifth day, excluding Saturdays, Sundays, and holidays, following adjournment sine die of the regular session of [2009;]      ; or

     (2)  Upon acceptance of the final environmental impact statement as provided in this Act; and

provided further that:

     (1)  The final environmental impact statement by the department of transportation that is accepted by the office of environmental quality control under this Act shall be and remain effective for all purposes under the laws of this state, notwithstanding the repeal of this Act;[and]

     (2)  Section 16 of this Act shall not be repealed when this Act is repealed[.]; and

     (3)  The authorization of any large capacity ferry vessel operating pursuant to section 3 of this Act shall terminate, unless the department of transportation and its large capacity ferry vessel company, as defined in section 2 of this Act, shall have entered into an agreement to finance the debt service and principal on the general obligation bonds issued to fund the improvements for the large capacity ferry service no later than the forty-fifth day, excluding Saturdays, Sundays, and holidays, following adjournment sine die of the regular session of      ."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2020.
