Florida Senate - 2022 SB 1786 By Senator Pizzo 38-01556-22 20221786__ 1 A bill to be entitled 2 An act relating to trust funds; creating s. 339.0817, 3 F.S.; creating the Chet Smith Bike Path Trust Fund 4 within the Department of Transportation; providing the 5 purpose of the trust fund; specifying uses for the 6 moneys in the trust fund; requiring certain balances 7 in the trust fund at the end of a fiscal year to 8 remain available for specified purposes; providing for 9 future review and termination or re-creation of the 10 trust fund; amending s. 339.081, F.S.; requiring the 11 Chief Financial Officer to maintain the trust fund 12 within the State Treasury for the department; 13 providing a contingent effective date. 14 15 Be It Enacted by the Legislature of the State of Florida: 16 17 Section 1. Section 339.0817, Florida Statutes, is created 18 to read: 19 339.0817 Chet Smith Bike Path Trust Fund.— 20 (1) The Chet Smith Bike Path Trust Fund is created within 21 the Department of Transportation. The purpose of the trust fund 22 is for the deposit of funds received from the collection of 23 fines imposed under s. 318.195. 24 (2) Moneys deposited in the fund are available as a funding 25 source for the creation and maintenance of bicycle lanes or 26 bicycle paths as defined in s. 316.003(5) and (6), respectively. 27 (3) Notwithstanding s. 216.301 and pursuant to s. 216.351, 28 any balance in the trust fund at the end of any fiscal year 29 shall remain in the trust fund and be available for carrying out 30 the purposes of the trust fund. 31 (4) In accordance with s. 19(f)(2), Art. III of the State 32 Constitution, the Chet Smith Bike Path Trust Fund, unless 33 terminated sooner, shall be terminated on October 1, 2026. 34 Before its scheduled termination, the trust fund shall be 35 reviewed as provided in s. 215.3206(1) and (2). 36 Section 2. Subsection (1) of section 339.081, Florida 37 Statutes, is amended to read: 38 339.081 Department trust funds.—The Chief Financial Officer 39 shall maintain within the State Treasury the following trust 40 funds for the department: 41 (1) The State Transportation Trust Fund, to which shall be 42 credited the proceeds of the gas tax as authorized by chapter 43 83-3, Laws of Florida, the Chet Smith Bike Path Trust Fund, and 44 such other funds which accrue to the department which are not 45 required to be maintained in separate trust funds. 46 Section 3. This act shall take effect on the same date that 47 SB 476 or similar legislation takes effect, if such legislation 48 is adopted in the same legislative session or an extension 49 thereof and becomes a law.
