Florida Senate - 2017 SB 1452 By Senator Book 32-00992-17 20171452__ 1 A bill to be entitled 2 An act relating to taximeters; amending s. 531.37, 3 F.S.; revising the definition of the term “weights and 4 measures”; amending s. 531.61, F.S.; deleting a 5 provision exempting certain taximeters from specified 6 permit requirements; amending s. 531.63, F.S.; 7 deleting a provision prohibiting the annual permit 8 fees for taximeters from exceeding $50; providing an 9 effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Subsection (1) of section 531.37, Florida 14 Statutes, is amended to read: 15 531.37 Definitions.—As used in this chapter: 16 (1) “Weights and measures” means all weights and measures 17 of every kind, instruments, and devices for weighing and 18 measuring, and any appliance and accessories associated with any 19 or all such instruments and devices, excluding any device that 20 measures time and distance for the purpose of charging a fare 21 for the transportation of persons in a motor vehicle and those 22 weights and measures used for the purpose of inspecting the 23 accuracy of devices used in conjunction with aviation fuel. 24 Section 2. Subsection (1) of section 531.61, Florida 25 Statutes, is amended, and present subsections (2) and (3) of 26 that section are redesignated as subsections (1) and (2), 27 respectively, to read: 28 531.61 Exemptions from permit requirement.—Commercial 29 weights or measures instruments or devices are exempt from the 30 requirements of ss. 531.60-531.66 if: 31(1) The device is a taximeter that is licensed, permitted,32or registered by a municipality, county, or other local33government and is tested for accuracy and compliance with state34standards by the local government in cooperation with the state35as authorized in s. 531.421.36 Section 3. Paragraph (g) of subsection (2) of section 37 531.63, Florida Statutes, is amended, and present paragraphs (h) 38 and (i) of that subsection are redesignated as paragraphs (g) 39 and (h), respectively, to read: 40 531.63 Maximum permit fees.—The commercial use permit fees 41 established for weights or measures instruments or devices shall 42 be in an amount necessary to administer this chapter but may not 43 exceed the amounts provided in this section. 44 (2) For other measuring devices, the annual permit fees per 45 device may not exceed the following: 46(g) Taximeters.......................................$50.47 Section 4. This act shall take effect July 1, 2017.
