AN ACT CONCERNING PATIENT CONSENT FOR THE EXCHANGE OF ELECTRONIC HEALTH INFORMATION.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Section 19a-25c of the general statutes is repealed and the following is substituted in lieu thereof (Effective October 1, 2011):

(a) A health care institution licensed by the Department of Public Health pursuant to chapter 368v may create, maintain or utilize medical records or a medical records system in electronic format, paper format or both, provided such records or system is designed to store medical records or patient health information in a medium that is reproducible and secure.

(b) A health care institution that maintains or utilizes a medical records system in an electronic format shall not release patient health information unless the patient or the patient's authorized representative consents, in writing, to the release of such information.

This act shall take effect as follows and shall amend the following sections:

To protect patient privacy by requiring a patient to opt-in to the exchange of electronic health records.
